The Cabinet hereby establishes this Cabinet Order, which amends in whole the Order for Enforcement of the Employees' Pension Insurance Act (Cabinet Order No. 239 of 1953), pursuant to the provisions of Article 4 and Article 82, paragraph (4) of the Employees' Pension Insurance Act (Act No. 115 of 1954).

内閣は、厚生年金保険法（昭和二十九年法律第百十五号）第四条及び第八十二条第四項の規定に基き、厚生年金保険法施行令（昭和二十八年政令第二百三十九号）の全部を改正するこの政令を制定する。

Article 1Affairs and Implementing Organizations Specified by Cabinet Order under Article 2-5, Paragraph (2) of the Act

第一条（法第二条の五第二項の政令で定める事務及び実施機関）

With regard to the affairs listed in Article 2-5, paragraph (1), item (ii) of the Employees' Pension Insurance Act (Act No. 115 of 1954) (hereinafter referred to as the "Act"), those that relate to the provisions set out in the following items are to be performed by the person specified in each of those items among the persons specified in item (ii) of that paragraph.

厚生年金保険法（以下「法」という。）第二条の五第一項第二号に掲げる事務のうち次の各号に掲げる規定に係るものについては、同項第二号に定める者のうち当該各号に定める者が行うものとする。

the following provisions: National Public Servants Mutual Aid Associations;

次に掲げる規定　国家公務員共済組合

Articles 21 through 24, Article 24-4, Article 81-2 and Article 81-2-2 of the Act, and Article 4-3 of the Supplementary Provisions of the Act;

法第二十一条から第二十四条まで、第二十四条の四、第八十一条の二及び第八十一条の二の二並びに法附則第四条の三

Article 26 of the Act (limited to where it is applied to a category II EPI insured (meaning a category II EPI insured prescribed in Article 2-5, paragraph (1), item (ii) of the Act; the same applies hereinafter));

法第二十六条（第二号厚生年金被保険者（法第二条の五第一項第二号に規定する第二号厚生年金被保険者をいう。以下同じ。）に適用される場合に限る。）

Articles 78-2, 78-6 and 78-8 of the Act (limited to where they are applied to a category II EPI insured or a person who was the spouse of such a person);

法第七十八条の二、第七十八条の六及び第七十八条の八（第二号厚生年金被保険者又はその配偶者であつた者に適用される場合に限る。）

Articles 78-4 and 78-5 of the Act (limited to where they are applied to a category II EPI insured, the spouse thereof, or a person who was a spouse);

法第七十八条の四及び第七十八条の五（第二号厚生年金被保険者又はその配偶者若しくは配偶者であつた者に適用される場合に限る。）

Articles 78-14 and 78-16 of the Act (limited to where they are applied to a person who had come under Article 7, paragraph (1), item (iii) of the National Pension Act (Act No. 141 of 1959) as the spouse of a category II EPI insured);

Article 28, Article 81, Article 100-2, Article 100-3, paragraphs (3) through (5), and Article 100-3-2 of the Act: National Public Servants Mutual Aid Associations and the Federation of National Public Service Personnel Mutual Aid Associations;

the following provisions: the Federation of National Public Service Personnel Mutual Aid Associations.

次に掲げる規定　国家公務員共済組合連合会

Article 26 of the Act (excluding where it is applied to a category II EPI insured);

法第二十六条（第二号厚生年金被保険者に適用される場合を除く。）

Articles 78-2, 78-6 and 78-8 of the Act (excluding where they are applied to a category II EPI insured or a person who was the spouse of such a person);

法第七十八条の二、第七十八条の六及び第七十八条の八（第二号厚生年金被保険者又はその配偶者であつた者に適用される場合を除く。）

Articles 78-4 and 78-5 of the Act (excluding where they are applied to a category II EPI insured, the spouse thereof, or a person who was a spouse);

法第七十八条の四及び第七十八条の五（第二号厚生年金被保険者又はその配偶者若しくは配偶者であつた者に適用される場合を除く。）

Articles 78-14 and 78-16 of the Act (excluding where they are applied to a person who had come under Article 7, paragraph (1), item (iii) of the National Pension Act as the spouse of a category II EPI insured);

第一号イ及び前号に掲げる規定並びに法第二十六条、第七十八条の二、第七十八条の四から第七十八条の六まで、第七十八条の八、第七十八条の十四及び第七十八条の十六以外の法の規定

With regard to the affairs listed in Article 2-5, paragraph (1), item (iii) of the Act, those that relate to the provisions set out in the following items are to be performed by the person specified in each of those items among the persons specified in item (iii) of that paragraph.

法第二条の五第一項第三号に掲げる事務のうち次の各号に掲げる規定に係るものについては、同項第三号に定める者のうち当該各号に定める者が行うものとする。

Articles 78-2 and 78-6 through 78-8 of the Act (limited to where they are applied to a category III EPI insured (meaning a category III EPI insured prescribed in Article 2-5, paragraph (1), item (iii) of the Act; the same applies hereinafter) who is a member of a constituent association (meaning a constituent association prescribed in Article 27, paragraph (2) of the Local Public Officers, etc. Mutual Aid Association Act (Act No. 152 of 1962); the same applies hereinafter) or a person who was the spouse of such a person);

法第七十八条の二及び第七十八条の六から第七十八条の八まで（構成組合（地方公務員等共済組合法（昭和三十七年法律第百五十二号）第二十七条第二項に規定する構成組合をいう。以下同じ。）の組合員たる第三号厚生年金被保険者（法第二条の五第一項第三号に規定する第三号厚生年金被保険者をいう。以下同じ。）又はその配偶者であつた者に適用される場合に限る。）

Articles 28, 81, 95 and 96 of the Act: Local Public Servants Mutual Aid Associations (in the case where they are applied to a category III EPI insured who is a member of a constituent association or a person who was a category III EPI insured who is a member of a constituent association, constituent associations and the National Federation of Mutual Aid Associations for Municipal Personnel);

法第二十八条、第八十一条、第九十五条及び第九十六条　地方公務員共済組合（構成組合の組合員たる第三号厚生年金被保険者又は構成組合の組合員たる第三号厚生年金被保険者であつた者に適用される場合にあつては、構成組合及び全国市町村職員共済組合連合会）

Articles 79-2 and 79-3 of the Act: Local Public Servants Mutual Aid Associations (in the case where they are applied to a category III EPI insured who is a member of a constituent association or a person who was a category III EPI insured who is a member of a constituent association, the National Federation of Mutual Aid Associations for Municipal Personnel) and the Pension Fund Association for Local Government Officials;

法第七十九条の二及び第七十九条の三　地方公務員共済組合（構成組合の組合員たる第三号厚生年金被保険者又は構成組合の組合員たる第三号厚生年金被保険者であつた者に適用される場合にあつては、全国市町村職員共済組合連合会）及び地方公務員共済組合連合会

Articles 79 and 80 of the Act: Local Public Servants Mutual Aid Associations (in the case where they are applied to a category III EPI insured who is a member of a constituent association or a person who was a category III EPI insured who is a member of a constituent association, constituent associations and the National Federation of Mutual Aid Associations for Municipal Personnel) and the Pension Fund Association for Local Government Officials;

Articles 100-2 and 100-3-2 of the Act: Local Public Servants Mutual Aid Associations, the National Federation of Mutual Aid Associations for Municipal Personnel and the Pension Fund Association for Local Government Officials;

Article 1-2Persons Specified by Cabinet Order in Article 6, Paragraph (1), Item (i), (q) of the Act

第一条の二（法第六条第一項第一号レの政令で定める者）

The persons specified by Cabinet Order in Article 6, paragraph (1), item (i), (q) of the Act are as follows:

法第六条第一項第一号レの政令で定める者は、次のとおりとする。

a notary public;

公証人

a judicial scrivener;

司法書士

a land and house investigator;

土地家屋調査士

an administrative scrivener;

行政書士

a maritime procedure agent;

海事代理士

a certified public tax accountant;

税理士

a labor and social security attorney;

社会保険労務士

an Okinawa attorney prescribed in Article 1 of the Cabinet Order on Okinawa Attorneys (Cabinet Order No. 169 of 1972);

沖縄弁護士に関する政令（昭和四十七年政令第百六十九号）第一条に規定する沖縄弁護士

a registered foreign lawyer;

外国法事務弁護士

a patent attorney.

Article 1-3Special Provisions on Calculation of the Monthly Amount of Remuneration

第一条の三（報酬月額の算定に関する特例）

Where there is a person who has acquired status as a category II EPI insured or a category III EPI insured and that person's remuneration is determined on a monthly basis, notwithstanding the provisions of Article 22, paragraph (1), item (i) of the Act, the amount of remuneration that the category II EPI insured or category III EPI insured would receive in the month in question if the person had acquired that status on the first day of the month is the amount specified in that item.

第二号厚生年金被保険者又は第三号厚生年金被保険者の資格を取得した者がある場合において、その者の報酬が月によつて定められるときは、法第二十二条第一項第一号の規定にかかわらず、当該第二号厚生年金被保険者又は第三号厚生年金被保険者が月の初日に当該資格を取得したとしたならば同月において受けるべき報酬の額を、同号に定める額とする。

Article 1-4Persons Specified by Cabinet Order Prescribed in Article 23-2, Paragraph (1) of the Act

第一条の四（法第二十三条の二第一項に規定する政令で定める者）

The persons specified by Cabinet Order prescribed in Article 23-2, paragraph (1) of the Act are as follows:

法第二十三条の二第一項に規定する政令で定める者は、次のとおりとする。

a child prescribed in Article 3, paragraph (1) of the Act on Childcare Leave, etc. of Diet Officers (Act No. 108 of 1991);

国会職員の育児休業等に関する法律（平成三年法律第百八号）第三条第一項に規定する子

a child prescribed in Article 3, paragraph (1) of the Act on Childcare Leave, etc. of National Public Officers (Act No. 109 of 1991) (including as applied mutatis mutandis pursuant to Article 27, paragraph (1) of that Act and the Act on Temporary Measures concerning Court Officials (Act No. 299 of 1951) (limited to the portion pertaining to item (vii)));

国家公務員の育児休業等に関する法律（平成三年法律第百九号）第三条第一項（同法第二十七条第一項及び裁判所職員臨時措置法（昭和二十六年法律第二百九十九号）（第七号に係る部分に限る。）において準用する場合を含む。）に規定する子

a child prescribed in Article 2, paragraph (1) of the Act on Childcare Leave, etc. of Local Public Officers (Act No. 110 of 1991);

地方公務員の育児休業等に関する法律（平成三年法律第百十号）第二条第一項に規定する子

a child prescribed in Article 2, paragraph (1) of the Act on Childcare Leave for Judges (Act No. 111 of 1991).

裁判官の育児休業に関する法律（平成三年法律第百十一号）第二条第一項に規定する子

Article 1-5Revision of Pension Amount, etc. in Cases Where Article 26, Paragraph (1) of the Act Applies

第一条の五（法第二十六条第一項の規定の適用がある場合における年金の額の改定等）

The previous standard monthly remuneration prescribed in Article 26, paragraph (1) of the Act that has been deemed, pursuant to Article 26, paragraph (1) of the Act, to be the standard monthly remuneration forming the basis for calculating the average standardized amount of remuneration prescribed in Article 43, paragraph (1) of the Act for the month in which it falls below that amount is to be the basis for calculation when revising the amount of a pension pursuant to Article 43, paragraphs (2) and (3) of the Act, and Article 7-3, paragraph (5) and Article 13-4, paragraphs (5) and (6) of the Supplementary Provisions of the Act.

法第二十六条第一項の規定により当該下回る月の法第四十三条第一項に規定する平均標準報酬額の計算の基礎となる標準報酬月額とみなされた法第二十六条第一項に規定する従前標準報酬月額は、法第四十三条第二項及び第三項並びに附則第七条の三第五項並びに第十三条の四第五項及び第六項の規定により年金の額を改定するに当たつての計算の基礎とする。

When a request under Article 26, paragraph (1) of the Act has been accepted by the employer of the place of business or office (hereinafter simply referred to as the "place of business") at which the insured person (limited to a category I EPI insured prescribed in Article 2-5, paragraph (1), item (i) of the Act (hereinafter referred to as a "category I EPI insured") or a category IV EPI insured prescribed in item (iv) of that paragraph (hereinafter referred to as a "category IV EPI insured")) is employed, the request is deemed to have been made, at the time of its acceptance, to the Japan Pension Service (hereinafter referred to as "JPS") or to the Promotion and Mutual Aid Corporation for Private Schools of Japan as an implementing organization (meaning an implementing organization prescribed in Article 2-5, paragraph (1) of the Act; the same applies hereinafter).

法第二十六条第一項の申出が当該被保険者（法第二条の五第一項第一号に規定する第一号厚生年金被保険者（以下「第一号厚生年金被保険者」という。）又は同項第四号に規定する第四号厚生年金被保険者（以下「第四号厚生年金被保険者」という。）に限る。）の使用される事業所又は事務所（以下単に「事業所」という。）の事業主に受理されたときは、その受理されたときに日本年金機構（以下「機構」という。）又は実施機関（法第二条の五第一項に規定する実施機関をいう。以下同じ。）たる日本私立学校振興・共済事業団に申出があつたものとみなす。

Article 2Starting Fiscal Year of the Term under Adjustment

第二条（調整期間の開始年度）

The starting fiscal year of the term under adjustment prescribed in Article 34, paragraph (1) of the Act is fiscal year 2005.

法第三十四条第一項に規定する調整期間の開始年度は、平成十七年度とする。
