Judicial enforcement may be continued even if the obligor died after its commencement.
強制執行は、その開始後に債務者が死亡した場合においても、続行することができる。
In the cases of the preceding paragraph, if existence of an heir to the obligor or the whereabouts of this person is unknown, the enforcement court may, upon petition, appoint a special representative for the inherited property or heir.
前項の場合において、債務者の相続人の存在又はその所在が明らかでないときは、執行裁判所は、申立てにより、相続財産又は相続人のために、特別代理人を選任することができる。
The provisions of Article 35, paragraphs (2) and (3) of the Code of Civil Procedure apply mutatis mutandis to the special representative referred to in the preceding paragraph.
民事訴訟法第三十五条第二項及び第三項の規定は、前項の特別代理人について準用する。
