Where the Minister for Internal Affairs and Communications (hereinafter referred to as "Minister") and the Prime Minister (or the Minister, where it concerns the transmission of electronic mails to fictitious electronic mail addresses) find that with respect to transmission of electronic mails, including simultaneous transmission of specified electronic mails to many persons, a sender does not comply with the provisions of Article 3 or Article 4, or where they find that a sender has sent electronic mails using false Sender Information or electronic mails to fictitious electronic mail addresses, and when they find that it is necessary for preventing disturbances upon transmission and reception of electronic mails, they may order that sender (or, in the case where an entrusting party for those electronic mails has carried out part of the operations relating to the sending of the electronic mails, such as receiving the notice referred to in Article 3, paragraph (1), item (i) or (ii) or retaining the records referred to in paragraph (2) of that Article for the sending of the electronic mails, and it is found that there are grounds attributable to that entrusting party with respect to the sending of the electronic mails, that sender and that entrusting party) to take necessary measures for improving the methods for electronic mail transmission.
