If an appeal to the court of second instance is not in accordance with the law and this defect clearly cannot be corrected, the court of first instance must rule to deny the appeal, in the form of a ruling.
控訴が不適法でその不備を補正することができないことが明らかであるときは、第一審裁判所は、決定で、控訴を却下しなければならない。
An immediate appeal may be filed against a ruling as referred to in the preceding paragraph.
