In petitioning for an order to submit a document, the following particulars must be made clear:
文書提出命令の申立ては、次に掲げる事項を明らかにしてしなければならない。
the indications of the document;
文書の表示
the purport of the document;
文書の趣旨
the person in possession of the document;
文書の所持者
the facts to be proven by the document;
証明すべき事実
the cause of the obligation to submit the document.
文書の提出義務の原因
It is not permissible for a petition for an order to submit a document to be filed on the grounds that the document falls under any of the categories listed in item (iv) of the preceding Article, unless it is necessary to offer documentary evidence by way of a petition for an order to submit a document.
前条第四号に掲げる場合であることを文書の提出義務の原因とする文書提出命令の申立ては、書証の申出を文書提出命令の申立てによってする必要がある場合でなければ、することができない。
