第二条（経過措置）
With regard to the reinsurance relationships established between the government and insurers, and the insurance relationships established between the government and cooperatives, before this Act comes into effect, the provisions of Articles 40 through 51 and Article 83 of the Act on Securing Compensation for Automobile Accidents prior to amendment by the provisions of Article 1 (hereinafter referred to as the "Former Act on Securing Compensation for Automobile Accidents") remain in force even after this Act comes into effect.
In the case referred to in the preceding paragraph, in Article 51 of the Former Act on Securing Compensation for Automobile Accidents that remains in force pursuant to that paragraph, the phrase "special account for automobile liability reinsurance" is deemed to be replaced with "special automobile safety account"; in Article 28-4, paragraph (1), item (i) of the Act on Securing Compensation for Automobile Accidents as amended by the provisions of Article 1 (hereinafter referred to as the "New Act on Securing Compensation for Automobile Accidents"), the phrase "Article 78" is deemed to be replaced with "Article 78, and Articles 40 and 46 of the Act on Securing Compensation for Automobile Accidents prior to amendment by the provisions of Article 1 of the Act Partially Amending the Act on Securing Compensation for Automobile Accidents and the Act on the Special Account for Automobile Liability Reinsurance (Act No. 83 of 2001; hereinafter referred to as the 'Amending Act') that remains in force pursuant to Article 2, paragraph (1) of the Supplementary Provisions of the Amending Act (hereinafter referred to as the 'Former Act on Securing Compensation for Automobile Accidents Still in Force') (including as applied mutatis mutandis pursuant to Article 50, paragraph (1) of the Former Act on Securing Compensation for Automobile Accidents Still in Force)", and the phrase "that Article" is deemed to be replaced with "Article 78"; in item (ii) of that paragraph, the phrase "including as applied mutatis mutandis pursuant to Article 23-3, paragraph (1))" is deemed to be replaced with "including as applied mutatis mutandis pursuant to Article 23-3, paragraph (1)) and Articles 40 and 45 (including as applied mutatis mutandis pursuant to Article 50, paragraph (1) of the Former Act on Securing Compensation for Automobile Accidents Still in Force) of the Former Act on Securing Compensation for Automobile Accidents Still in Force"; in paragraph (2) of the Supplementary Provisions of the New Act on Securing Compensation for Automobile Accidents, the phrase "Article 82, paragraph (2)" is deemed to be replaced with "Article 82, paragraph (2), and Article 51 of the Former Act on Securing Compensation for Automobile Accidents Still in Force"; and in paragraph (3) of the Supplementary Provisions of the Act on Securing Compensation for Automobile Accidents, the phrase "Article 213, paragraph (1), item (i), (f)" is deemed to be replaced with "in Article 56 of the Supplementary Provisions, the phrase 'in Article 215, paragraph (1), the phrase "the expenses required for the execution of the operations of" is deemed to be replaced with "and the expenses required for the execution of the operations of the automobile liability reinsurance business, etc. based on the provisions of Article 51 of the Former Act on Securing Compensation for Automobile Accidents Still in Force", and in Article 216,' is deemed to be replaced with 'in Article 216,', and Article 213, paragraph (1), item (i), (f) of that Act".
前項の場合においては、同項の規定によりなおその効力を有することとされた旧自賠法第五十一条中「自動車損害賠償責任再保険特別会計」とあるのは「自動車安全特別会計」と、第一条の規定による改正後の自動車損害賠償保障法（以下「新自賠法」という。）第二十八条の四第一項第一号中「第七十八条」とあるのは「第七十八条並びに自動車損害賠償保障法及び自動車損害賠償責任再保険特別会計法の一部を改正する法律（平成十三年法律第八十三号。以下「改正法」という。）附則第二条第一項の規定によりなおその効力を有することとされた改正法第一条の規定による改正前の自動車損害賠償保障法（以下「なお効力を有する旧自賠法」という。）第四十条及び第四十六条（なお効力を有する旧自賠法第五十条第一項において準用する場合を含む。）」と、「同条」とあるのは「第七十八条」と、同項第二号中「準用する場合を含む。）」とあるのは「準用する場合を含む。）並びになお効力を有する旧自賠法第四十条及び第四十五条（なお効力を有する旧自賠法第五十条第一項において準用する場合を含む。）」と、新自賠法附則第二項中「第八十二条第二項」とあるのは「第八十二条第二項及びなお効力を有する旧自賠法第五十一条」と、自動車損害賠償保障法附則第三項中「第二百十三条第一項第一号ヘ」とあるのは「附則第五十六条中「第二百十五条第一項中「の業務の執行に要する経費」とあるのは「及びなお効力を有する旧自賠法第五十一条の規定に基づく自動車損害賠償責任再保険事業等の業務の執行に要する経費」と、第二百十六条中」とあるのは「第二百十六条中」とし、同法第二百十三条第一項第一号ヘ」とする。
