第八条の五（二以上の種別の被保険者であつた期間を有する者に係る特例による老齢厚生年金の特例の適用に関する読替え等）
In the case of applying the provisions of Article 8 of the Supplementary Provisions of the Act (including where applied with the deemed replacement of terms pursuant to the provisions of Article 8-2 of the Supplementary Provisions of the Act) to a person who has spent time as an insured person in two or more categories, the provisions of Article 8-2 of the Supplementary Provisions of the Act apply to each employees' old-age pension of that person based on a category of EPI insured period. In this case, in paragraph (3) of that Article, the phrase "item (i) of that Article" is deemed to be replaced with "in that Article, the phrase 'employees' old-age pension' is deemed to be replaced with 'employees' old-age pension based on a category I EPI insured period', and item (i) of that Article"; in paragraph (4) of that Article, the phrase "item (i) of that Article" is deemed to be replaced with "in that Article, the phrase 'employees' old-age pension' is deemed to be replaced with 'employees' old-age pension based on a category III EPI insured period', and item (i) of that Article", and the phrase ", respectively" is deemed to be replaced with " respectively".
二以上の種別の被保険者であつた期間を有する者について、法附則第八条（法附則第八条の二の規定により読み替えて適用する場合を含む。）の規定を適用する場合においては、当該者の各号の厚生年金被保険者期間に基づく老齢厚生年金ごとに法附則第八条の二の規定を適用する。この場合において、同条第三項中「同条第一号」とあるのは「同条中「老齢厚生年金」とあるのは「第一号厚生年金被保険者期間に基づく老齢厚生年金」と、同条第一号」と、同条第四項中「同条第一号」とあるのは「同条中「老齢厚生年金」とあるのは「第三号厚生年金被保険者期間に基づく老齢厚生年金」と、同条第一号」と、「、それぞれ」とあるのは「それぞれ」とする。
