If the application under the preceding Article conforms to the following standards, the Director of a District Transport Bureau must grant certification of a motor vehicle specified maintenance business:
that the facilities and employees of the place of business conform to the standards prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism;
当該事業場の設備及び従業員が、国土交通省令で定める基準に適合するものであること。
that the applicant does not fall under any of the following:
申請者が、次に掲げる者に該当しないものであること。
a person who has been sentenced to imprisonment for one year or more and for whom two years have not elapsed from the day on which the execution of the sentence ended or the person ceased to be subject to its execution;
一年以上の拘禁刑に処せられ、その執行を終わり、又は執行を受けることがなくなつた日から二年を経過しない者
a person who has had the certification of a motor vehicle specified maintenance business revoked pursuant to Article 93 and for whom two years have not elapsed from the day of the revocation (including, where the person whose certification was revoked is a juridical person, a person who was an officer of that juridical person (including a person who, regardless of title, has authority or control equal to or greater than that of an officer; the same applies in (d)) within 60 days before the date of the public notice under Article 103, paragraph (2) concerning the date and place of the hearing relating to the revocation, and for whom two years have not elapsed from the day of the revocation);
a minor who does not have the same capacity to act as an adult in relation to business, whose legal representative falls under (a), (b) or (d);
営業に関し成年者と同一の行為能力を有しない未成年者であつて、その法定代理人がイ、ロ又はニのいずれかに該当するもの
a juridical person any of whose officers falls under (a), (b) or (c).
法人であつて、その役員のうちにイ、ロ又はハのいずれかに該当する者があるもの
The standards under item (i) of the preceding paragraph must be the minimum necessary for the specified maintenance of motor vehicles, by type of motor vehicle specified maintenance business.
