第五条
For the period until the day on which two years and six months have elapsed from the date of enforcement of this Act, in Article 7-2, paragraph (1) of the New Medical Care Act, the phrase "the number of long-term care beds and general beds" is deemed to be replaced with "the number of transitional former other beds prescribed in Article 2, paragraph (3), item (iv) of the Supplementary Provisions of the Act Partially Amending the Medical Care Act, etc. (Act No. 141 of 2000; hereinafter referred to as the "Amending Act" in this Article) (hereinafter referred to as "transitional former other beds" in this Article), long-term care beds and general beds", the phrase "the Order of the Ministry of Health, Labour and Welfare under paragraph (4) of the same Article" is deemed to be replaced with "the Order of the Ministry of Health, Labour and Welfare under Article 30-3, paragraph (4) as applied with the replacement of terms pursuant to Article 7, paragraph (1) of the Supplementary Provisions of the Amending Act", and the phrase "the target number of long-term care beds and general beds" is deemed to be replaced with "the target number of transitional former other beds, long-term care beds and general beds"; and in paragraph (2) of that Article, the phrase "the number of long-term care beds and general beds" is deemed to be replaced with "the number of transitional former other beds, long-term care beds and general beds, as applied with the replacement of terms pursuant to Article 7, paragraph (1) of the Supplementary Provisions of the Amending Act", and the phrase "the target number of long-term care beds and general beds" is deemed to be replaced with "the target number of transitional former other beds, long-term care beds and general beds".
この法律の施行の日から二年六月を経過する日までの間は、新医療法第七条の二第一項中「療養病床及び一般病床の数」とあるのは「医療法等の一部を改正する法律（平成十二年法律第百四十一号。以下この条において「改正法」という。）附則第二条第三項第四号に規定する経過的旧その他の病床（以下この条において「経過的旧その他の病床」という。）、療養病床及び一般病床の数」と、「同条第四項の厚生労働省令」とあるのは「改正法附則第七条第一項により読み替えて適用される第三十条の三第四項の厚生労働省令」と、「療養病床及び一般病床に係る基準病床数」とあるのは「経過的旧その他の病床、療養病床及び一般病床に係る基準病床数」と、同条第二項中「療養病床及び一般病床の数が、」とあるのは「経過的旧その他の病床、療養病床及び一般病床の数が、改正法附則第七条第一項により読み替えて適用される」と、「療養病床及び一般病床に係る基準病床数」とあるのは「経過的旧その他の病床、療養病床及び一般病床に係る基準病床数」とする。
