常時百人以上の労働者を使用する事業場において業務上負傷し、又は疾病にかかつた労働者と同一職種の同一条件の労働者がいない場合における当該労働者の休業補償の額の改訂は、当該事業場の全労働者に対して所定労働時間労働した場合に支払われる通常の賃金の四半期ごとの平均給与額が上昇し又は低下した場合に行うものとする。
If there exists no worker whose work and working conditions are the same as those of a worker who suffers an injured or illness in the course of employment in a workplace which usually employs 100 workers or more, the amount of the compensation for absence from work paid to the worker shall be adjusted when the quarterly average of the ordinary wages paid to all the workers in said workplace for the prescribed working hours is increased or decreased.
