A person who intends to carry out any of the following acts (hereinafter referred to as "specified modification, etc.") with regard to a motor vehicle issued with a motor vehicle inspection certificate, etc. must obtain permission from the Minister of Land, Infrastructure, Transport and Tourism in advance, as provided by Order of the Ministry of Land, Infrastructure, Transport and Tourism:
自動車検査証交付済自動車等について、次に掲げる行為（以下「特定改造等」という。）をしようとする者は、国土交通省令で定めるところにより、あらかじめ、国土交通大臣の許可を受けなければならない。
the act of carrying out, by a method using a telecommunications line or any other method specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism, a modification of a motor vehicle by altering a program, etc. (meaning a program or other information used for processing by a computer; the same applies hereinafter) incorporated in an automated operation device or other equipment, that is specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as one in which, unless the program, etc. for that modification is appropriate, the motor vehicle is likely to fail to conform to the safety standards; or
the act of providing, by a method using a telecommunications line or any other method specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism, the user of a motor vehicle or any other person with the program, etc. for the modification, for the purpose of having the modification prescribed in the preceding item carried out.
The provisions of Article 78, paragraphs (3) and (4) apply mutatis mutandis to the permission referred to in the preceding paragraph. In this case, the term "conditions" in these provisions is deemed to be replaced with "conditions or time limits".
The Minister of Land, Infrastructure, Transport and Tourism may not grant the permission referred to in paragraph (1) unless the Minister finds that the application for that permission conforms to the following standards:
the applicant is a person who conforms to the standards specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as a person having the capability and system sufficient to appropriately carry out specified modification, etc.; and
申請者が特定改造等を適確に実施するに足りる能力及び体制を有する者として国土交通省令で定める基準に適合する者であること。
the motor vehicle modified by altering the program, etc. in the application conforms to the safety standards.
A person who has obtained the permission referred to in paragraph (1) must maintain the person's capability and system so as to conform to the standards specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as referred to in item (i) of the preceding paragraph.
In addition to what is provided for in the preceding paragraph, a person who has obtained the permission referred to in paragraph (1) must comply with the matters specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as necessary for ensuring the appropriate management of programs, etc., reliable alteration, and other appropriate implementation of specified modification, etc.
If the Minister of Land, Infrastructure, Transport and Tourism finds that the capability and system of a person who has obtained the permission referred to in paragraph (1) do not conform to the standards specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as referred to in item (i) of paragraph (3), or that a person who has obtained the permission referred to in paragraph (1) is not complying, with regard to specified modification, etc., with the matters specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as referred to in the preceding paragraph, the Minister may order that person to take the measures necessary to bring the person's capability and system into conformity with the standards or to ensure the appropriate implementation of specified modification, etc.
If a person who has obtained the permission referred to in paragraph (1) falls under any of the following items, the Minister of Land, Infrastructure, Transport and Tourism may, by specifying a period, order the suspension of specified modification, etc., or revoke the permission referred to in that paragraph:
the person violates this Act, an order under this Act, or a disposition under this Act or an order under this Act;
この法律若しくはこの法律に基づく命令又はこれらに基づく処分に違反したとき。
the person violates a condition attached to the permission pursuant to Article 78, paragraph (3) as applied mutatis mutandis pursuant to paragraph (2); or
the person obtains the permission referred to in paragraph (1) by deception or other wrongful means.
偽りその他不正の手段により第一項の許可を受けたとき。
The Minister of Land, Infrastructure, Transport and Tourism is to have the Agency carry out the following among the affairs relating to the permission referred to in paragraph (1):
examination of whether an applicant for the permission referred to in paragraph (1) has the capability sufficient to appropriately carry out specified modification, etc.; and
examination of whether a motor vehicle modified by altering the program, etc. in an application for the permission referred to in paragraph (1) conforms to the safety standards.
When the Agency has conducted the examinations set forth in the items of the preceding paragraph, it must notify the Minister of Land, Infrastructure, Transport and Tourism of the results of those examinations without delay, as provided by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
