Article 74-5Entrustment of Affairs Relating to Recording on Motor Vehicle Inspection Certificates, etc. for Continuing Inspections
第七十四条の五（継続検査に係る自動車検査証への記録等に関する事務の委託）
The Minister of Land, Infrastructure, Transport and Tourism may, as prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism, entrust the affairs relating to the recording on a motor vehicle inspection certificate and the return of the motor vehicle inspection certificate under Article 62, paragraph (2) and the issuance of an inspection mark under Article 66, paragraph (2) (excluding the determination of the result of continuing inspections and other affairs prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism) to a person who meets the requirements prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
A person who has received entrustment under the preceding paragraph (referred to as "specified recording agent" in the following paragraph and Article 100, paragraph (1), item (viii)) must not do any of the following:
where a person who is to have a motor vehicle inspection certificate returned pursuant to Article 62, paragraph (2) so requests, failing to make the record on that motor vehicle inspection certificate, failing to return it, or failing to issue an inspection mark, without a disaster or other unavoidable reason;
第六十二条第二項の規定により自動車検査証の返付を受けるべき者の請求がある場合において、災害その他やむを得ない事由がないのに当該自動車検査証への記録をせず、若しくはこれを返付せず、又は検査標章を交付しないこと。
in the case prescribed in the preceding item, making a record on a motor vehicle inspection certificate other than that motor vehicle inspection certificate, returning a motor vehicle inspection certificate to a person other than the person referred to in that item, or issuing an inspection mark to a person other than the person referred to in that item.
Article 28, paragraph (1) and Article 28-2, paragraph (1) apply mutatis mutandis to the case where a specified recording agent carries out the affairs relating to recording on motor vehicle inspection certificates, return of motor vehicle inspection certificates and issuance of inspection marks.
第二十八条第一項及び第二十八条の二第一項の規定は、特定記録等事務代行者が自動車検査証への記録及び自動車検査証の返付並びに検査標章の交付に関する事務を行う場合について準用する。
