Article 5Acquisition of Status and Forfeiture of Status as an Elderly Voluntary Insured

第五条（高齢任意加入被保険者の資格の取得及び喪失）

The benefits in the nature of pensions having old age or retirement as the ground for payment that are specified by Cabinet Order as prescribed in Article 4-3, paragraph (1) of the Supplementary Provisions of the Act are as follows:

法附則第四条の三第一項に規定する老齢又は退職を支給事由とする年金たる給付であつて政令で定めるものは、次のとおりとする。

an employees' old-age pension and a special old-age pension, and an old-age pension, an aggregated old-age pension and a special old-age pension under the former Act;

老齢厚生年金及び特例老齢年金並びに旧法による老齢年金、通算老齢年金及び特例老齢年金

an old-age basic pension under the National Pension Act and an old-age pension under Article 9-3, paragraph (1) of the Supplementary Provisions of that Act, and an old-age pension and an aggregated old-age pension under the former National Pension Act;

国民年金法による老齢基礎年金及び同法附則第九条の三第一項の規定による老齢年金並びに旧国民年金法による老齢年金及び通算老齢年金

an old-age pension, an aggregated old-age pension and a special old-age pension under the former Mariners Insurance Act;

旧船員保険法による老齢年金、通算老齢年金及び特例老齢年金

among national public officers' mutual aid pensions before the 2012 unification, a retirement mutual aid pension, and a retirement pension, a reduced retirement pension and an aggregated retirement pension under the pre-1985 National Public Officers, etc. Mutual Aid Association Act and the former National Enforcement Act;

平成二十四年一元化法改正前国共済年金のうち退職共済年金並びに旧国家公務員等共済組合法及び旧国の施行法による退職年金、減額退職年金及び通算退職年金

a retirement mutual aid pension under the provisions of Article 41, paragraph (1) of the Supplementary Provisions of the 2012 Pension Unification Act;

平成二十四年一元化法附則第四十一条第一項の規定による退職共済年金

among local public officers' mutual aid pensions before the 2012 unification, a retirement mutual aid pension, and benefits in the nature of pensions under the former Local Public Officers, etc. Mutual Aid Association Act and the former Local Enforcement Act that have retirement as the ground for payment;

平成二十四年一元化法改正前地共済年金のうち退職共済年金並びに旧地方公務員等共済組合法及び旧地方の施行法による年金たる給付であつて退職を支給事由とするもの

a retirement mutual aid pension under the provisions of Article 65, paragraph (1) of the Supplementary Provisions of the 2012 Pension Unification Act;

平成二十四年一元化法附則第六十五条第一項の規定による退職共済年金

among private school personnel mutual aid pensions before the 2012 unification, a retirement mutual aid pension, and a retirement pension, a reduced retirement pension and an aggregated retirement pension under the pre-1985 Private School Personnel Mutual Aid Association Act;

平成二十四年一元化法改正前私学共済年金のうち退職共済年金並びに旧私立学校教職員共済組合法による退職年金、減額退職年金及び通算退職年金

a transitional retirement mutual aid pension, and a transitional retirement pension, a transitional reduced retirement pension and a transitional aggregated retirement pension (meaning the aggregated retirement pension among transitional agricultural, forestry and fishery pensions; the same applies hereinafter);

移行退職共済年金並びに移行退職年金、移行減額退職年金及び移行通算退職年金（移行農林年金のうち通算退職年金をいう。以下同じ。）

a benefit in the nature of a pension under the Public Officers Pension Act (including as applied mutatis mutandis under other Acts) that has retirement as the ground for payment;

恩給法（他の法律において準用する場合を含む。）による年金たる給付であつて退職を支給事由とするもの

a benefit in the nature of a pension under a Prefectural or Municipal Ordinance on retirement pensions for local public officers that has retirement as the ground for payment;

地方公務員の退職年金に関する条例による年金たる給付であつて退職を支給事由とするもの

a benefit in the nature of a pension paid by a mutual aid association prescribed in Article 28 of the Supplementary Provisions of the Act that has retirement as the ground for payment;

法附則第二十八条に規定する共済組合が支給する年金たる給付であつて退職を支給事由とするもの

a benefit in the nature of a pension under Article 13 of the Supplementary Provisions of the former Court Enforcement Officer Act that has retirement as the ground for payment;

旧執行官法附則第十三条の規定による年金たる給付であつて退職を支給事由とするもの

a benefit in the nature of a pension paid by the Federation of National Public Service Personnel Mutual Aid Associations under the Act on Special Measures concerning Beneficiaries of Pension of Mutual Aid Association Established under Former Ordinances that has retirement as the ground for payment;

旧令による共済組合等からの年金受給者のための特別措置法によつて国家公務員共済組合連合会が支給する年金たる給付であつて退職を支給事由とするもの

the ordinary retirement pension under Article 7, paragraph (1) of the Supplementary Provisions of the Act to Abolish the Diet Members' Mutual Aid Pension Act (Act No. 1 of 2006; hereinafter referred to as the "Abolition Act" in this item) and the ordinary retirement pension under Article 9, paragraph (1) of the Diet Members' Mutual Aid Pension Act (Act No. 70 of 1958) prior to the abolition by the Abolition Act, which remains in force pursuant to Article 2, paragraph (1) of the Supplementary Provisions of the Abolition Act; and

国会議員互助年金法を廃止する法律（平成十八年法律第一号。以下この号において「廃止法」という。）附則第七条第一項の普通退職年金及び廃止法附則第二条第一項の規定によりなおその効力を有することとされる廃止法による廃止前の国会議員互助年金法（昭和三十三年法律第七十号）第九条第一項の普通退職年金

the former retirement pension under Article 2 of the Supplementary Provisions of the Act Partially Amending the Local Public Officers, etc. Mutual Aid Association Act (Act No. 56 of 2011) and the special retirement pension under Article 12, paragraph (1) of the Supplementary Provisions of that Act that are paid by the surviving mutual aid society prescribed in Article 23, paragraph (1), item (iii) of the Supplementary Provisions of that Act.

地方公務員等共済組合法の一部を改正する法律（平成二十三年法律第五十六号）附則第二十三条第一項第三号に規定する存続共済会が支給する同法附則第二条の旧退職年金及び同法附則第十二条第一項の特例退職年金
