The court in charge of an appeal may not revoke the ruling in prior instance unless it hears statements from a party in the prior instance and any other person subject to adjudication (excluding the appellant).
抗告裁判所は、原審における当事者及びその他の審判を受ける者（抗告人を除く。）の陳述を聴かなければ、原審判を取り消すことができない。
In adjudication cases regarding any of the matters set forth in Appended Table 2, the court in charge of an appeal must hear statements from a party in the prior instance (excluding the appellant), except when the immediate appeal is unlawful or the immediate appeal is clearly groundless.
別表第二に掲げる事項についての審判事件においては、抗告裁判所は、即時抗告が不適法であるとき又は即時抗告に理由がないことが明らかなときを除き、原審における当事者（抗告人を除く。）の陳述を聴かなければならない。
