In proceedings for adjudication of domestic relations regarding a parent and child, parental authority or guardianship of a minor, or in proceedings for adjudication of domestic relations, the outcome of which would affect a minor (including a minor ward; hereinafter the same applies in this Article), the family court must try to understand the intentions of the child by hearing statements from the child, having a family court investigating officer conduct an examination or using any other appropriate methods, and to take the child's intentions into consideration in adjudicating the case, according to the child's age or degree of development.
家庭裁判所は、親子、親権又は未成年後見に関する家事審判その他未成年者である子（未成年被後見人を含む。以下この条において同じ。）がその結果により影響を受ける家事審判の手続においては、子の陳述の聴取、家庭裁判所調査官による調査その他の適切な方法により、子の意思を把握するように努め、審判をするに当たり、子の年齢及び発達の程度に応じて、その意思を考慮しなければならない。
