The compensation set forth in each of the following items is made by a ruling of the court which rendered the acquittal, upon the request of the person prescribed in that item.
次の各号に掲げる補償は、当該各号に定める者の請求により、無罪の判決をした裁判所が、決定をもつてこれを行う。

the compensation prescribed in paragraph (2) of the preceding Article: the requester of a commenced retrial.
The request prescribed in the preceding paragraph must be made within six months after the acquittal becomes final and binding.
前項の請求は、無罪の判決が確定した後六月以内にこれをしなければならない。
An immediate appeal against a ruling on compensation may be filed.

In Chapter XVI (compensation for costs), the person, other than a public prosecutor, who made the request for a retrial (再審) on which a ruling to commence the retrial (再審開始の決定) was made; where that ruling has become final and the defendant is then acquitted, the State compensates this person for the costs of the request procedure.
