If a debtor does not lodge an objection to an electronic demand for payment within two weeks from the day on which the debtor is served with that electronic demand for payment, the court clerk, at the petition of the creditor, must issue a declaration of provisional enforceability, attaching a supplementary note of the amount of expenses for demand procedures to the electronic demand for payment; provided, however, that this does not apply if an objection to the demand is lodged prior to that declaration.
債務者が電子支払督促の送達を受けた日から二週間以内に督促異議の申立てをしないときは、裁判所書記官は、債権者の申立てにより、電子支払督促に手続の費用額を併せて記録して仮執行の宣言をしなければならない。ただし、その宣言前に督促異議の申立てがあったときは、この限りでない。
Any declaration of provisional enforceability must be recorded in an electronic demand for payment, as provided for by the Rules of the Supreme Court, and the demand for payment must be served on the parties; provided, however, that with the consent of the creditor, a paper document prepared by outputting the information contained in the electronic demand for payment in which a declaration of provisional enforceability has been recorded may be sent to the creditor, in lieu of service.
仮執行の宣言は、最高裁判所規則で定めるところにより、電子支払督促に記録し、これを当事者に送達しなければならない。ただし、債権者の同意があるときは、当該債権者に対しては、当該記録をした電子支払督促に記録された事項を出力することにより作成した書面を送付することをもって、送達に代えることができる。
The provisions of Article 385, paragraphs (2) and (3) apply mutatis mutandis to a disposition denying, a petition as referred to in paragraph (1) and to the lodging of an objection against such a disposition.
第三百八十五条第二項及び第三項の規定は、第一項の申立てを却下する処分及びこれに対する異議の申立てについて準用する。
An immediate appeal may be filed against a judicial decision on an objection as referred to in the preceding paragraph.
前項の異議の申立てについての裁判に対しては、即時抗告をすることができる。
The provisions of Article 260 and Article 388, paragraph (2) apply mutatis mutandis to a declaration of provisional enforceability as referred to in paragraph (1).
第二百六十条及び第三百八十八条第二項の規定は、第一項の仮執行の宣言について準用する。
