Article 816Reversion of the Surname upon Dissolution of the Adoptive Relationship

An adopted child reverts to the surname used before the adoption upon dissolution of the adoptive relationship; provided, however, that this does not apply in the event of a dissolution of the adoptive relationship between the adopted child and only one of the adoptive parents that adopted that child together with the spouse.

A person who has reverted to the surname used before adoption pursuant to the provisions of the preceding paragraph and who has done so after seven years have passed since the date of the adoption may take the surname used at the time of the dissolution of the adoptive relationship by filing a registration pursuant to the provisions of the Family Register Act within three months of the date of its dissolution.
