Supplementary Provisions, Article 4
第四条
The parties to a contract of automobile insurance for a motorized bicycle (meaning an insurance contract intended to indemnify the loss that the insured may incur by becoming liable to compensate for damage inflicted on the life or body of another person through the operation of a motorized bicycle) that was concluded before October 1, 1966 (hereinafter referred to as an "old insurance contract") may cancel the old insurance contract when a liability insurance contract is concluded for that motorized bicycle.
When an old insurance contract has been cancelled pursuant to the provisions of the preceding paragraph, the insurer under the old insurance contract must pay the policyholder a cancellation refund in the amount specified by Cabinet Order.
When a liability insurance contract is concluded for the motorized bicycle concerned, the amount of insurance coverage under the old insurance contract is deemed to have increased to the amount specified by Cabinet Order.
When a liability insurance contract is concluded for the motorized bicycle concerned, the policyholder under the old insurance contract may demand that the insurer under the old insurance contract pay the amount specified by Cabinet Order; provided, however, that this does not apply when the old insurance contract has been cancelled pursuant to the provisions of paragraph (1).
If the policyholder under an old insurance contract has made the demand under the main clause of the preceding paragraph, then on and after that time the amount of insurance coverage under the old insurance contract is to revert to the amount before it was increased pursuant to the provisions of paragraph (3).
If a liability insurance contract is concluded for a motorized bicycle covered by an old insurance contract, and loss arises that is to be indemnified under both the old insurance contract and the liability insurance contract, the loss is first indemnified under the liability insurance contract, and if the amount so indemnified is not sufficient to indemnify the whole of the loss, the shortfall is indemnified under the old insurance contract.
