Article 309Transfer on the Grounds of Lack of Jurisdiction of the Court of First Instance
第三百九条（第一審の管轄違いを理由とする移送）
If the court of second instance sets aside the judgment in the first instance on the grounds of lack of jurisdiction over the case, it must transfer the case to the court of jurisdiction.
控訴裁判所は、事件が管轄違いであることを理由として第一審判決を取り消すときは、判決で、事件を管轄裁判所に移送しなければならない。
