Supplementary Provisions, Article 1Effective Date

第一条(施行期日)

This Act comes into effect on the date specified by Cabinet Order within a period not exceeding one year from the date of promulgation.

この法律は、公布の日から起算して一年を超えない範囲内において政令で定める日から施行する。

Supplementary Provisions, Article 2Transitional Measures Concerning Exclusion from Application of the Minimum Wage

第二条(最低賃金の適用除外に関する経過措置)

With regard to a worker for whom an employer has, at the time this Act comes into effect, obtained permission from the Director of the Prefectural Labor Bureau or the Director of the District Transport Bureau (including the Director of the Transport Supervision Department) under the provisions of prior to the amendment by this Act (hereinafter referred to as "the former Act"), or of the former Act as applied with the replacement of terms pursuant to of the former Act, the provisions of Article 4 of the Minimum Wage Act as amended by this Act (hereinafter referred to as "the new Act") do not apply for one year from the day this Act comes into effect; provided, however, that this does not apply where, within that period, the permission of the Director of the Prefectural Labor Bureau or the Director of the District Transport Bureau (including the Director of the Transport Supervision Department) has been obtained for that worker under the provisions of Article 7 of the new Act, or Article 7 of the new Act as applied with the replacement of terms pursuant to Article 35, paragraph (2) of the new Act.

この法律の施行の際現にこの法律による改正前の最低賃金法(以下「旧法」という。)又はの規定により読み替えられたの規定により使用者が都道府県労働局長又は地方運輸局長(運輸監理部長を含む。)の許可を受けている労働者については、この法律の施行の日から一年間は、この法律による改正後の最低賃金法(以下「新法」という。)第四条の規定は、適用しない。ただし、当該労働者について、当該期間内に新法第七条又は新法第三十五条第二項の規定により読み替えられた新法第七条の規定による都道府県労働局長又は地方運輸局長(運輸監理部長を含む。)の許可があったときは、この限りでない。

Supplementary Provisions, Article 3Transitional Measures Concerning the Minimum Wage Decided under the Provisions of the Former Act

第三条(旧法の規定により決定された最低賃金に関する経過措置)

With regard to the minimum wage decided, and in effect at the time this Act comes into effect, under the provisions of of the former Act (including one amended under the provisions of of the former Act), the provisions of of the former Act remain in force for two years after this Act comes into effect.

この法律の施行の際現に効力を有するの規定により決定された最低賃金(の規定により改正されたものを含む。)については、この法律の施行後二年間は、の規定は、なおその効力を有する。

Supplementary Provisions, Article 4

第四条

The minimum wage decided for a specific region under the provisions of of the former Act, and in effect at the time this Act comes into effect (including one amended under the provisions of of the former Act), is deemed to be a minimum wage decided under the provisions of Article 10, paragraph (1) of the new Act.

この法律の施行の際現に効力を有するの規定により一定の地域について決定された最低賃金(の規定により改正されたものを含む。)は、新法第十条第一項の規定により決定された最低賃金とみなす。

Supplementary Provisions, Article 5

第五条

The minimum wage decided for a specific business or occupation under the provisions of of the former Act, and in effect at the time this Act comes into effect (including one amended under the provisions of of the former Act, but excluding one prescribed in the following Article), is deemed to be a minimum wage decided under the provisions of Article 15, paragraph (2) of the new Act.

この法律の施行の際現に効力を有するの規定により一定の事業又は職業について決定された最低賃金(の規定により改正されたものを含み、次条に規定するものを除く。)は、新法第十五条第二項の規定により決定された最低賃金とみなす。

With regard to a minimum wage deemed under the provisions of the preceding paragraph to be a minimum wage decided under the provisions of Article 15, paragraph (2) of the new Act, the provisions of Article 3 of the new Act do not apply until a decision to amend or abolish that minimum wage under the provisions of that paragraph first takes effect on or after the day this Act comes into effect.

前項の規定により新法第十五条第二項の規定により決定された最低賃金とみなされた最低賃金については、この法律の施行の日以後最初に同項の規定による当該最低賃金の改正又は廃止の決定が効力を生ずるまでの間は、新法第三条の規定は、適用しない。

Supplementary Provisions, Article 6

第六条

The minimum wage that is in effect at the time this Act comes into effect and applies to mariners (meaning mariners to whom the applies), and that was decided under the provisions of of the former Act (including one amended under the provisions of of the former Act), is deemed to be a minimum wage decided under the provisions of Article 35, paragraph (3) of the new Act.

この法律の施行の際現に効力を有する船員(の適用を受ける船員をいう。)に適用される最低賃金であって、の規定により決定されたもの(の規定により改正されたものを含む。)は、新法第三十五条第三項の規定により決定された最低賃金とみなす。

Supplementary Provisions, Article 7Transitional Measures Concerning the Term of Office of Members

第七条(委員の任期に関する経過措置)

With regard to the term of office of a person who is a member of the Central Minimum Wage Council or a Local Minimum Wage Council on the day preceding the day this Act comes into effect, the provisions then in force continue to govern.

この法律の施行の日の前日において中央最低賃金審議会又は地方最低賃金審議会の委員である者の任期については、なお従前の例による。

Supplementary Provisions, Article 8Transitional Measures Concerning Penal Provisions

第八条(罰則に関する経過措置)

With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.

この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。

Supplementary Provisions, Article 9Delegation of Other Transitional Measures to Cabinet Order

第九条(その他の経過措置の政令への委任)

Beyond what is provided for in Article 2 through the preceding Article of the Supplementary Provisions, transitional measures necessary for the enforcement of this Act (including transitional measures concerning penal provisions) are specified by Cabinet Order.

附則第二条から前条までに定めるもののほか、この法律の施行に関し必要な経過措置(罰則に関する経過措置を含む。)は、政令で定める。

Supplementary Provisions, Article 10Review

第十条(検討)

The Government, with a target of five years after this Act comes into effect, is to take into consideration the status of enforcement of the provisions as amended by this Act, and other circumstances, and conduct a review of the approach to regulation under the provisions of the new Act, and, when it finds it necessary, is to take the necessary measures based on the results of that review.

政府は、この法律の施行後五年を目途として、この法律の規定による改正後の規定の施行の状況等を勘案し、新法の規定に基づく規制の在り方について検討を加え、必要があると認めるときは、その結果に基づいて必要な措置を講ずるものとする。
