第十条（残余財産に関する経過措置）
The provisions of Article 44, paragraph (5) of the Medical Care Act apply to the authorization under paragraph (1) of that Article for which an application is filed on or after the Effective Date, and the provisions then in force continue to govern the authorization under that paragraph for which an application is filed before the Effective Date.
医療法第四十四条第五項の規定は、施行日以後に申請された同条第一項の認可について適用し、施行日前に申請された同項の認可については、なお従前の例による。
With regard to a medical corporation established before the Effective Date, or a medical corporation that filed an application for the authorization under Article 44, paragraph (1) of the Medical Care Act before the Effective Date and received authorization for establishment on or after the Effective Date, that, as of the Effective Date, has not established in its articles of incorporation or act of endowment provisions on the person to whom the residual assets are to belong, or has provided as the person to whom the residual assets are to belong a person other than those prescribed in paragraph (5) of that Article, for the time being (where that medical corporation has, on or after the Effective Date, made a change of its articles of incorporation or act of endowment the content of which is to determine as the person to whom the residual assets are to belong a person prescribed in that paragraph, until it receives the approval under Article 50, paragraph (1) of that Act for that change of the articles of incorporation or act of endowment), the provisions of Article 50, paragraph (4) of that Act do not apply, and the provisions of Article 56 of the Former Medical Care Act remain in force.
施行日前に設立された医療法人又は施行日前に医療法第四十四条第一項の規定による認可の申請をし、施行日以後に設立の認可を受けた医療法人であって、施行日において、その定款又は寄附行為に残余財産の帰属すべき者に関する規定を設けていないもの又は残余財産の帰属すべき者として同条第五項に規定する者以外の者を規定しているものについては、当分の間（当該医療法人が、施行日以後に、残余財産の帰属すべき者として、同項に規定する者を定めることを内容とする定款又は寄附行為の変更をした場合には、当該定款又は寄附行為の変更につき同法第五十条第一項の認可を受けるまでの間）、同法第五十条第四項の規定は適用せず、旧医療法第五十六条の規定は、なおその効力を有する。
