To the extent necessary for the enforcement of the provisions of the preceding two Articles, the Minister of Land, Infrastructure, Transport and Tourism may have a motor vehicle manufacturer, etc. that manufactured or imported non-conforming motor vehicles (including an equipment manufacturer, etc. that manufactured or imported, among the devices of those non-conforming motor vehicles (excluding aftermarket devices; the same applies hereinafter in this paragraph), those that the Minister finds may not conform to the safety standards), an equipment manufacturer, etc. that manufactured or imported non-conforming specified aftermarket devices, a motor vehicle manufacturer, etc. that made a notification under paragraph (1) of the preceding Article (including an equipment manufacturer, etc. that manufactured or imported, among the motor vehicle devices relating to that notification, those that the Minister finds to be in a condition in which they are likely to cease to conform to the safety standards or do not conform to them), or an equipment manufacturer, etc. that made a notification under paragraph (2) of that Article make a report concerning its business, or have the Minister's staff members enter the offices or other places of business of that motor vehicle manufacturer, etc. or equipment manufacturer, etc., inspect books and documents and other articles, or question persons concerned.
国土交通大臣は、前二条の規定の施行に必要な限度において、基準不適合自動車を製作し、若しくは輸入した自動車製作者等（当該基準不適合自動車の装置（後付装置を除く。以下この項において同じ。）のうち、保安基準に適合していないおそれがあると認めるものを製作し、又は輸入した装置製作者等を含む。）若しくは基準不適合特定後付装置を製作し、若しくは輸入した装置製作者等又は前条第一項の規定による届出をした自動車製作者等（当該届出に係る自動車の装置のうち、保安基準に適合しなくなるおそれがある状態又は適合していない状態にあると認めるものを製作し、又は輸入した装置製作者等を含む。）若しくは同条第二項の規定による届出をした装置製作者等に対し、その業務に関し報告をさせ、又はその職員に、当該自動車製作者等若しくは装置製作者等の事務所その他の事業場に立ち入り、帳簿書類その他の物件を検査させ、若しくは関係者に質問させることができる。
A staff member who conducts an on-site inspection pursuant to the preceding paragraph must carry an identification card showing his or her status and must present it when requested by a person concerned.
前項の規定により立入検査をする職員は、その身分を示す証票を携帯し、かつ、関係者の請求があるときは、これを提示しなければならない。
The authority to conduct on-site inspections under paragraph (1) must not be construed as being vested for criminal investigation.
第一項の規定による立入検査の権限は、犯罪捜査のために認められたものと解釈してはならない。
