Supplementary Provisions, Article 38Transitional Measures Concerning the Real Property Registration Act
第三十八条（不動産登記法に関する経過措置）
If the date of enforcement of this Act comes before the date of enforcement of the Real Property Registration Act, then with regard to the application, until the day preceding the date of enforcement of that Act, of the provisions of Article 142, paragraphs (1) and (2) of the Real Property Registration Act (Act No. 24 of 1899), the phrase "pursuant to the provisions of the Act on Public Notification Procedures (Act No. 29 of 1890)" in paragraph (1) of that Article is deemed to be replaced with "prescribed in Article 141 of the Non-Contentious Case Procedures Act", and the phrase "judgment of nullification of right" in paragraph (2) of that Article is deemed to be replaced with "order of nullification of right prescribed in Article 148, paragraph (1) of the Non-Contentious Case Procedures Act".
この法律の施行の日が不動産登記法の施行の日前である場合には、同法の施行の日の前日までの間における不動産登記法（明治三十二年法律第二十四号）第百四十二条第一項及び第二項の規定の適用については、同条第一項中「公示催告手続ニ関スル法律（明治二十三年法律第二十九号）ノ規定ニ従ヒテ」とあるのは「非訟事件手続法第百四十一条ニ規定スル」と、同条第二項中「除権判決」とあるのは「非訟事件手続法第百四十八条第一項ニ規定スル除権決定」とする。
