Article 33-2Restrictions on concluding sales agreements for non-owned Real Estate
第三十三条の二(自己の所有に属しない宅地又は建物の売買契約締結の制限)
A Real Estate Broker is not to conclude a sales agreement (including a reservation) under which the Real Estate Broker will constitute the seller of a Building Lot or building that it does not own. Provided, however, this does not apply in a case falling under either of the following items:
when the Real Estate Broker has concluded an agreement for the acquisition of said Building Lot or building (including booking; excluding any such agreement in which conditions are affected by the effectiveness thereof) or otherwise when as specified by an Ordinance of the Ministry of Land, Infrastructure, Transport and Tourism and Cabinet Office Ordinance in a case in which the Real Estate Broker is clearly able to acquire said Building Lot or building;
when, in a case in which the sale of said Building Lot or building corresponds to a sale as prescribed in Article 41, paragraph (1), measures as listed in item (i) or (ii) of the same paragraph concerned with said sale have been taken.
