Supplementary Provisions, Article 4Transitional Measures Concerning Preparation of Working Hours Reduction Plans
第四条(労働時間短縮計画の作成に関する経過措置)
If, during the period until the day preceding the day this Act comes into effect (hereinafter referred to as the "Effective Date"), the working hours of a physician working at a hospital (meaning a hospital prescribed in Article 1-5, paragraph (1) of the Medical Care Act; the same applies hereinafter) or a clinic (meaning a clinic prescribed in paragraph (2) of that Article; the same applies hereinafter) exceed the hours specified by Order of the Ministry of Health, Labour and Welfare, the administrator of that hospital or clinic must make efforts to prepare a plan for shortening the working hours of that physician (hereinafter referred to as a "plan for shortening working hours").
In preparing a plan for shortening working hours, the administrator of a hospital or clinic must, pursuant to the provisions of an Order of the Ministry of Health, Labour and Welfare, hear the opinions of the physicians working at that hospital or clinic and other persons concerned.
When the administrator of a hospital or clinic has prepared a plan for shortening working hours, that administrator may, pursuant to the provisions of an Order of the Ministry of Health, Labour and Welfare, submit that plan for shortening working hours to the prefectural governor for the location of that hospital or clinic (referred to simply as the "prefectural governor" in this Article).
When the prefectural governor has received the submission of a plan for shortening working hours pursuant to the provisions of the preceding paragraph, the prefectural governor is to, as necessary, provide the relevant hospital or clinic with support such as the provision of information useful for reducing the working hours of the physicians working at that hospital or clinic, and advice.
When the administrator of a hospital or clinic, after submitting a plan for shortening working hours pursuant to the provisions of paragraph (3), has made a change to that plan for shortening working hours in light of the status of efforts to reduce the working hours of the physicians working at that hospital or clinic, the administrator must, pursuant to the provisions of an Order of the Ministry of Health, Labour and Welfare, submit the plan for shortening working hours after the change to the prefectural governor.
