Supplementary Provisions, Article 3Transitional Measures Concerning Beds in Clinics Other Than Long-Term Care Beds
第三条（診療所の療養病床以外の病床に関する経過措置）
A bed in a clinic other than a long-term care bed for whose buildings and equipment a license was issued pursuant to Article 27 of the Medical Care Act before the date on which the provisions set forth in Article 1, item (ii) of the Supplementary Provisions come into effect is deemed, on that date, to be a bed for which permission to set up a general bed in a clinic has been received under Article 7, paragraph (3) of the Medical Care Act as amended by the provisions of Article 1.
The following beds are not to be subject to a recommendation by the prefectural governor under Article 30-7 of the Medical Care Act as amended by the provisions of Article 1, notwithstanding the provisions of that Article:
a bed in a clinic other than a long-term care bed pertaining to an application for permission to establish a clinic or permission to change the number of beds that, before the date on which the provisions set forth in Article 1, item (ii) of the Supplementary Provisions come into effect, is in fact being made pursuant to Article 7, paragraph (1) or (2) of the Medical Care Act before its amendment by the provisions of Article 1
a bed in a clinic other than a long-term care bed pertaining to a written application for confirmation that, before the date on which the provisions set forth in Article 1, item (ii) of the Supplementary Provisions come into effect, is in fact accepted by the building official under Article 4 of the Building Standards Act (Act No. 201 of 1950) pursuant to Article 6, paragraph (1) of that Act (including as applied mutatis mutandis pursuant to Article 87, paragraph (1) of that Act)
A bed deemed under paragraph (1) to have received permission to set up a general bed in a clinic and a bed listed in the items of the preceding paragraph (referred to as a "specified bed" in the following paragraph) are not to be included in the number of general beds prescribed in Article 7-2, paragraphs (1) and (2) of the Medical Care Act as amended by the provisions of Article 1, from the date on which the provisions set forth in Article 1, item (ii) of the Supplementary Provisions come into effect until the date specified by Cabinet Order.
A specified bed is not to be included in the number of general beds prescribed in Article 7-2, paragraph (3) of the Medical Care Act as amended by the provisions of Article 2 (hereinafter referred to as the "New Medical Care Act"), from the date of enforcement of this Act (hereinafter referred to as the "Effective Date") until the date specified by Cabinet Order in the preceding paragraph.
