第三条の十二の四（対象期間に係る被保険者期間の計算）
In the case of calculating the aggregate amount of standardized remuneration for the subject period (meaning the aggregate amount of standardized remuneration for the subject period prescribed in Article 78-3, paragraph (1) of the Act; the same applies in the following Article), with regard to the insured period relating to the subject period (meaning the subject period prescribed in Article 78-2, paragraph (1) of the Act; the same applies hereinafter in this Article and the following Article), as specified by Order of the Ministry of Health, Labour and Welfare, where the month that includes the first day of the subject period is an insured period, that month is included in it, and where the month that includes the last day of the subject period is an insured period, that month is not included in it; provided, however, that where the first day and the last day of the subject period fall in the same month, that month is not included in the insured period relating to the subject period.
対象期間標準報酬総額（法第七十八条の三第一項に規定する対象期間標準報酬総額をいう。次条において同じ。）を計算する場合における対象期間（法第七十八条の二第一項に規定する対象期間をいう。以下この条及び次条において同じ。）に係る被保険者期間については、厚生労働省令で定めるところにより、対象期間の初日の属する月が被保険者期間であるときはその月をこれに算入し、対象期間の末日の属する月が被保険者期間であるときはその月をこれに算入しない。ただし、対象期間の初日と末日が同一の月に属するときは、その月は、対象期間に係る被保険者期間に算入しない。
