Article 3-12-2Cases Specified by Cabinet Order under Article 78-10, Paragraph (1) of the Act, etc.

一in the case where, with regard to a beneficiary of an employees' old-age pension under Article 42 of the Act (excluding a beneficiary who is an insured person), the standardized remuneration (meaning the standardized remuneration prescribed in Article 28 of the Act; the same applies hereinafter) has been revised or decided pursuant to Article 78-6, paragraphs (1) and (2) of the Act (hereinafter referred to in this Article as "revision, etc. of standardized remuneration on divorce"): the insured period before the month that includes the day on which the request for standardized remuneration to be revised or decided was made;

三in the case where, with regard to a beneficiary of an employees' old-age pension under Article 42 of the Act who is an insured person, revision, etc. of standardized remuneration on divorce has been made after a revision under Article 43, paragraph (2) of the Act (excluding the case where a revision under Article 43, paragraph (3) of the Act was made between the revision under Article 43, paragraph (2) of the Act and the revision, etc. of standardized remuneration on divorce): the insured period before the month that includes the base date prescribed in Article 43, paragraph (2) of the Act relating to the most recent revision under that paragraph;

四in the case where, with regard to a beneficiary of an employees' old-age pension under Article 42 of the Act who is an insured person, after a revision under Article 43, paragraph (3) of the Act, there has again been an acquisition of status as an insured person and revision, etc. of standardized remuneration on divorce has been made (excluding the case where a revision under Article 43, paragraph (2) of the Act was made between the acquisition of status and the revision, etc. of standardized remuneration on divorce): the insured period before the month in which the person last lost status as an insured person relating to the revision under Article 43, paragraph (3) of the Act and the deemed insured period at divorce on or after the month in which the person last lost status as an insured person;

五in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 7-3, paragraph (3) of the Supplementary Provisions of the Act who is under the age of 65: the insured period before the month in which the beneficiary acquired the right and the deemed insured period at divorce on or after the month in which the beneficiary acquired that right;

六in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 7-3, paragraph (3) of the Supplementary Provisions of the Act who is age 65 or over (excluding a beneficiary who is an insured person): the insured period before the month that includes the day on which the request for standardized remuneration to be revised or decided was made;

七in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 7-3, paragraph (3) of the Supplementary Provisions of the Act who is an insured person age 65 or over (excluding the cases listed in the following item and item (ix)): the insured period before the month that includes the day on which the beneficiary reached the age of 65 and the deemed insured period at divorce on or after the month that includes the day on which the beneficiary reached the age of 65;

八in the case where, with regard to a beneficiary of an employees' old-age pension under Article 7-3, paragraph (3) of the Supplementary Provisions of the Act who is an insured person age 65 or over, revision, etc. of standardized remuneration on divorce has been made after a revision under Article 43, paragraph (2) of the Act (excluding the case where a revision under Article 43, paragraph (3) of the Act was made between the revision under Article 43, paragraph (2) of the Act and the revision, etc. of standardized remuneration on divorce): the insured period before the month that includes the base date prescribed in Article 43, paragraph (2) of the Act relating to the most recent revision under that paragraph;

九in the case where, with regard to a beneficiary of an employees' old-age pension under Article 7-3, paragraph (3) of the Supplementary Provisions of the Act who is an insured person age 65 or over, after a revision under Article 43, paragraph (3) of the Act, there has again been an acquisition of status as an insured person and revision, etc. of standardized remuneration on divorce has been made (excluding the case where a revision under Article 43, paragraph (2) of the Act was made between the acquisition of status and the revision, etc. of standardized remuneration on divorce): the insured period before the month in which the person last lost status as an insured person relating to the revision under Article 43, paragraph (3) of the Act and the deemed insured period at divorce on or after the month in which the person last lost status as an insured person;

十in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 8 of the Supplementary Provisions of the Act (excluding a beneficiary who is an insured person): the insured period before the month that includes the day on which the request for standardized remuneration to be revised or decided was made;

十一in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 8 of the Supplementary Provisions of the Act who is an insured person (excluding the case listed in the following item): the insured period before the month in which the beneficiary acquired the right and the deemed insured period at divorce on or after the month in which the beneficiary acquired that right;

十二in the case where, with regard to a beneficiary of an employees' old-age pension under Article 8 of the Supplementary Provisions of the Act who is an insured person, after a revision under Article 43, paragraph (3) of the Act, there has again been an acquisition of status as an insured person and revision, etc. of standardized remuneration on divorce has been made: the insured period before the month in which the person last lost status as an insured person relating to the revision under Article 43, paragraph (3) of the Act and the deemed insured period at divorce on or after the month in which the person last lost status as an insured person;

十三in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is under the age set out in the lower column of the table in each paragraph of Article 8-2 of the Supplementary Provisions of the Act (hereinafter referred to in this Article, Article 8-2-3, Article 8-2-4 and Article 8-2-6 as the "special starting age for payment"): the insured period before the month in which the beneficiary acquired the right and the deemed insured period at divorce on or after the month in which the beneficiary acquired that right;

十四in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is at or over the special starting age for payment (excluding a beneficiary who is an insured person): the insured period before the month that includes the day on which the request for standardized remuneration to be revised or decided was made;

十五in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is an insured person at or over the special starting age for payment and under the age of 65 (excluding the case listed in the following item): the insured period before the month that includes the day on which the beneficiary reached the special starting age for payment and the deemed insured period at divorce on or after the month that includes the day on which the beneficiary reached that special starting age for payment;

十六in the case where, with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is an insured person at or over the special starting age for payment and under the age of 65, after a revision under Article 43, paragraph (3) of the Act, there has again been an acquisition of status as an insured person and revision, etc. of standardized remuneration on divorce has been made: the insured period before the month in which the person last lost status as an insured person relating to the revision under Article 43, paragraph (3) of the Act and the deemed insured period at divorce on or after the month in which the person last lost status as an insured person;

十七in the case where revision, etc. of standardized remuneration on divorce has been made with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is an insured person age 65 or over (excluding the cases listed in the following item and item (xix)): the insured period before the month that includes the day on which the beneficiary reached the age of 65 and the deemed insured period at divorce on or after the month that includes the day on which the beneficiary reached the age of 65;

十八in the case where, with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is an insured person age 65 or over, revision, etc. of standardized remuneration on divorce has been made after a revision under Article 43, paragraph (2) of the Act (excluding the case where a revision under Article 43, paragraph (3) of the Act was made between the revision under Article 43, paragraph (2) of the Act and the revision, etc. of standardized remuneration on divorce): the insured period before the month that includes the base date prescribed in Article 43, paragraph (2) of the Act relating to the most recent revision under that paragraph;

十九in the case where, with regard to a beneficiary of an employees' old-age pension under Article 13-4, paragraph (3) of the Supplementary Provisions of the Act who is an insured person age 65 or over, after a revision under Article 43, paragraph (3) of the Act, there has again been an acquisition of status as an insured person and revision, etc. of standardized remuneration on divorce has been made (excluding the case where a revision under Article 43, paragraph (2) of the Act was made between the acquisition of status and the revision, etc. of standardized remuneration on divorce): the insured period before the month in which the person last lost status as an insured person relating to the revision under Article 43, paragraph (3) of the Act and the deemed insured period at divorce on or after the month in which the person last lost status as an insured person.
