When there are grounds as in the items set forth in the provisions of Article 377 through Article 382 and Article 383, the court shall, on a judgment, reverse the judgment made by the court of first instance.
第三百七十七条乃至第三百八十二条及び第三百八十三条に規定する事由があるときは、判決で原判決を破棄しなければならない。
As a result of the examination pursuant to the paragraph (2) of Article 393, the court of second instance may, on a judgment, reverse the judgment made by the court of first instance when it deems that not doing so would clearly be contrary to justice.
第三百九十三条第二項の規定による取調の結果、原判決を破棄しなければ明らかに正義に反すると認めるときは、判決で原判決を破棄することができる。
