Co-litigants bear court costs equally; provided, however, that the court, depending on the circumstances, may have co-litigants bear court costs jointly and severally or in any other manner.
共同訴訟人は、等しい割合で訴訟費用を負担する。ただし、裁判所は、事情により、共同訴訟人に連帯して訴訟費用を負担させ、又は他の方法により負担させることができる。
Notwithstanding the provisions of the preceding paragraph, the court may have a party that has performed any act that was unnecessary for the expansion or defense of a right bear court costs incurred due to that act.
裁判所は、前項の規定にかかわらず、権利の伸張又は防御に必要でない行為をした当事者に、その行為によって生じた訴訟費用を負担させることができる。
