In summary court, a trial and judicial decision may be sought through a small claims action in respect of a claim for the payment of money, if the value of the subject matter of litigation is not more than 600,000 yen; provided, however, that a person may not file these actions with the same summary court more frequently than the number of times specified by the Rules of the Supreme Court in the same year.
簡易裁判所においては、訴訟の目的の価額が六十万円以下の金銭の支払の請求を目的とする訴えについて、少額訴訟による審理及び裁判を求めることができる。ただし、同一の簡易裁判所において同一の年に最高裁判所規則で定める回数を超えてこれを求めることができない。
A statement indicating that a trial and judicial decision are sought through a small claims action must be entered at the time the action is filed.
少額訴訟による審理及び裁判を求める旨の申述は、訴えの提起の際にしなければならない。
In entering a statement as referred to in the preceding paragraph, the plaintiff must report the number of times in the relevant year that the plaintiff has sought trials and judicial decisions through small claims actions in the summary court where the plaintiff is filing the action.
前項の申述をするには、当該訴えを提起する簡易裁判所においてその年に少額訴訟による審理及び裁判を求めた回数を届け出なければならない。
