A marriage is void only in one of the following cases:
婚姻は、次に掲げる場合に限り、無効とする。
if the parties did not have the mutual intention to enter into a marriage due to a party being mistaken as to the identity of the other or any other such cause; or
人違いその他の事由によって当事者間に婚姻をする意思がないとき。
if the parties have failed to file an application to register the marriage; provided, however, that if the application to register merely lacks a formality prescribed in Article 739, paragraph (2), this does not impair the validity of the marriage.
当事者が婚姻の届出をしないとき。ただし、その届出が第七百三十九条第二項に定める方式を欠くだけであるときは、婚姻は、そのためにその効力を妨げられない。
