Article 398-4Alterations in Scope of Secured Claims Under Revolving Mortgages and of Obligors
第三百九十八条の四（根抵当権の被担保債権の範囲及び債務者の変更）
The scope of the claims to be secured by a revolving mortgage may be changed if the change is effected before the principal is fixed. The same applies with respect to change of obligors.
元本の確定前においては、根抵当権の担保すべき債権の範囲の変更をすることができる。債務者の変更についても、同様とする。
In order to effect the changes referred to in the preceding paragraph, it is not required that the approval of third parties including subordinated mortgagee be obtained.
前項の変更をするには、後順位の抵当権者その他の第三者の承諾を得ることを要しない。
If the change under paragraph (1) is not registered before the principal is fixed, it is deemed that the change was not effected.
第一項の変更について元本の確定前に登記をしなかったときは、その変更をしなかったものとみなす。
