第五条
In the case where payment of a surcharge is ordered pursuant to these provisions for a violation prescribed in Article 7-2, paragraph (4) or Articles 20-2 through 20-6 of the Act on Prohibition of Private Monopolization and Maintenance of Fair Trade after amendment by the Act Partially Amending the Act on Prohibition of Private Monopolization and Maintenance of Fair Trade (Act No. 100 of 2013) (referred to as the "New Act on Prohibition of Private Monopolization" in the following Article through Article 8 of the Supplementary Provisions, Article 15 of the Supplementary Provisions, and Article 16, paragraph (2) of the Supplementary Provisions), if the violation began before the Effective Date and ceased on or after the Effective Date, payment of a surcharge cannot be ordered for the part of the violation relating to the period before the Effective Date.
私的独占の禁止及び公正取引の確保に関する法律の一部を改正する法律（平成二十五年法律第百号）による改正後の私的独占の禁止及び公正取引の確保に関する法律（次条から附則第八条まで、附則第十五条及び附則第十六条第二項において「新私的独占禁止法」という。）第七条の二第四項又は第二十条の二から第二十条の六までに規定する違反行為についてこれらの規定による課徴金の納付を命ずる場合において、当該違反行為が施行日前に開始され、施行日以後になくなったものであるときは、当該違反行為のうち施行日前に係るものについては、課徴金の納付を命ずることができない。
