If the bankrupt (or a temporary administrator if any temporary administrator is appointed) has transferred property that is the subject matter of a right of segregation prior to the commencement of bankruptcy proceedings to a third party, the person that has a right of segregation over the property may request the transfer of a claim for counter-performance. The same applies when a bankruptcy trustee transfers property that is the subject matter of a right of segregation to a third party.
In the case referred to in the preceding paragraph, if a bankruptcy trustee has received counter-performance, the person that has a right of segregation stated in that paragraph may request the delivery of the property received by the bankruptcy trustee as the counter-performance.
