Supplementary Provisions, Article 1Effective Date
第一条(施行期日)
This Act comes into effect on the date specified by Cabinet Order within a period not exceeding six months from the date of promulgation; provided, however, that the provisions of Article 5 of the Supplementary Provisions come into effect on the date of promulgation.
この法律は、公布の日から起算して六月を超えない範囲内において政令で定める日から施行する。ただし、附則第五条の規定は、公布の日から施行する。
Supplementary Provisions, Article 2Transitional Measures Concerning Consent to the Sending of Specified Electronic Mail
第二条(特定電子メールの送信についての同意等に関する経過措置)
A person who, at the time this Act comes into effect, has already notified a sender of specified electronic mail (meaning specified electronic mail as specified in Article 2, item (ii) of the Act on Regulation of Transmission of Specified Electronic Mail as amended by this Act (hereinafter referred to as "the new Act" in this Article and the following Article); the same applies hereinafter in this Article) (meaning a sender as specified in Article 2, item (ii) of the new Act; the same applies hereinafter in this Article) or an entrusting party (meaning an entrusting party as specified in Article 3, paragraph (1), item (i) of the new Act; the same applies hereinafter in this Article) that the person requests the sending of that mail or consents to its sending is deemed to be a person set forth in Article 3, paragraph (1), item (i) of the new Act.
この法律の施行の際既に特定電子メール(この法律による改正後の特定電子メールの送信の適正化等に関する法律(以下この条及び次条において「新法」という。)第二条第二号に規定する特定電子メールをいう。以下この条において同じ。)の送信者(新法第二条第二号に規定する送信者をいう。以下この条において同じ。)又は送信委託者(新法第三条第一項第一号に規定する送信委託者をいう。以下この条において同じ。)に対し、その送信を求める旨又はその送信をすることに同意する旨の通知をしている者は、新法第三条第一項第一号に掲げる者とみなす。
A person who, at the time this Act comes into effect, has already notified a sender or an entrusting party of the person's own electronic mail address (meaning an electronic mail address as specified in Article 2, item (iii) of the new Act) is deemed to be a person set forth in Article 3, paragraph (1), item (ii) of the new Act.
この法律の施行の際既に自己の電子メールアドレス(新法第二条第三号に規定する電子メールアドレスをいう。)を送信者又は送信委託者に対し通知している者は、新法第三条第一項第二号に掲げる者とみなす。
A notice that has already been given to a sender or an entrusting party at the time this Act comes into effect, to the effect that the person giving it requests that specified electronic mail not be sent (or, in the case where the person requests that specified electronic mail concerning certain matters not be sent, to that effect), is deemed to be the notice prescribed in Article 3, paragraph (3) of the new Act.
Supplementary Provisions, Article 3Transitional Measures Concerning Administrative Orders
第三条(措置命令に関する経過措置)
An order issued before this Act comes into effect pursuant to the provisions of Article 7 of the Act on Regulation of Transmission of Specified Electronic Mail prior to amendment by this Act (referred to as "the former Act" in this Article) (limited to one relating to a provision of the former Act for which the new Act has a corresponding provision) is deemed to be an order issued pursuant to the provisions of Article 7 of the new Act.
Supplementary Provisions, Article 4Transitional Measures Concerning Penal Provisions
第四条(罰則に関する経過措置)
With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.
この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。
Supplementary Provisions, Article 5Delegation to Cabinet Order
第五条(政令への委任)
Beyond what is provided for in the preceding three Articles, the Transitional Measures necessary for the enforcement of this Act (including Transitional Measures concerning penal provisions) are specified by Cabinet Order.
前三条に定めるもののほか、この法律の施行に関し必要となる経過措置(罰則に関する経過措置を含む。)は、政令で定める。
Supplementary Provisions, Article 6Review
第六条(検討)
The Government is to, within three years after this Act comes into effect, examine the status of the enforcement of this Act, while taking into consideration the level of technology relating to telecommunications and other circumstances, and take necessary measures based on the results.
政府は、この法律の施行後三年以内に、電気通信に係る技術の水準その他の事情を勘案しつつ、この法律の施行の状況について検討を加え、その結果に基づいて必要な措置を講ずるものとする。
