A sender must not send specified electronic mail to any person other than the following persons:
a person who has notified the sender or the entrusting party (meaning a person who has entrusted the sending of electronic mail (limited to an organization for profit and an individual in cases where the individual is engaged in business); the same applies hereinafter) in advance that the person requests the sending of specified electronic mail or consents to its sending;
beyond what is set forth in the preceding item, a person who has notified the sender or the entrusting party of the person's own electronic mail address as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order;
beyond what is set forth in the preceding two items, a person who has a business relationship with a person engaged in the business for which advertisement or publicity is conducted by means of the specified electronic mail;
beyond what is set forth in the preceding three items, an organization or individual (limited, for an individual, to a person engaged in business) that has made public its own electronic mail address as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
前三号に掲げるもののほか、総務省令・内閣府令で定めるところにより自己の電子メールアドレスを公表している団体又は個人(個人にあっては、営業を営む者に限る。)
A person who has received the notice referred to in item (i) of the preceding paragraph must, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, retain records proving that there was a request for the sending of specified electronic mail or consent to its sending.
If a sender has received from a person set forth in any of the items of paragraph (1), as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, a notice to the effect that the person requests that specified electronic mail not be sent (or, in the case where the person requests that specified electronic mail concerning certain matters not be sent, a notice to that effect) (including when the entrusting party has received that notice), the sender must not send specified electronic mail against the intention indicated in that notice; provided, however, that this does not apply in the case where advertisement or publicity is conducted incidentally in electronic mail sent, based on the intention of the person who receives the electronic mail, with a principal purpose of an act other than advertisement or publicity, or in any other similar case specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
