Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Act comes into effect on January 1, 1987; provided, however, that the provisions set forth in the following items come into effect on the dates specified in those items:
この法律は、昭和六十二年一月一日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。
the provisions of Article 1 amending Article 7, paragraphs (1) and (2) of the Act on Health and Medical Services for the Elderly, the provision adding one paragraph to Article 7 of that Act, and the provision adding one Article after Article 31 of that Act (limited to the part pertaining to Article 31-2, paragraphs (7) and (8) of that Act), the provision of Article 4 amending Article 7, paragraph (2) of the Act on Health and Medical Services for the Elderly, the provision amending Article 8, paragraph (1) of that Act, the provision adding one Section after Section 3 of Chapter III of that Act (limited to the part pertaining to Article 46-2, paragraphs (5) and (6) of that Act) and the provision adding one Chapter after Chapter III of that Act (limited to the part pertaining to the provisions of Article 46-8, paragraphs (5) through (7) of that Act), and the provisions of Article 6, and the provisions of Article 4, paragraph (2), Article 12 and Article 13 of the Supplementary Provisions: the date of promulgation;
the provisions of Article 4 (excluding the amending provisions set forth in the preceding item), the provisions of Article 5 and the provisions of Article 7, and the provisions of Article 16, Articles 24 through 29, Article 31 and Article 35 of the Supplementary Provisions: the date specified by Cabinet Order within a period not exceeding one year and six months from the date of promulgation.
Supplementary Provisions, Article 2Transitional Measures Concerning Medical Expenses
第二条（医療費に関する経過措置）
With regard to the amount of medical expenses under the provisions of the Act on Health and Medical Services for the Elderly as it stood before the amendment by Article 1 (hereinafter referred to as the "Former Elderly Health Act") for medical care, provision of drugs or medical treatment provided before the date of enforcement of this Act (hereinafter referred to as the "Effective Date"), the provisions then in force continue to govern.
この法律の施行の日（以下「施行日」という。）前に行われた診療、薬剤の支給又は手当に係る第一条の規定による改正前の老人保健法（以下「旧老健法」という。）の規定による医療費の額については、なお従前の例による。
Supplementary Provisions, Article 3Transitional Measures Concerning Medical Expense Contributions, Etc.
第三条（医療費拠出金等に関する経過措置）
The provisions of the proviso to Article 54, paragraph (1) and Article 54, paragraph (2) of the Act on Health and Medical Services for the Elderly as amended by Article 1 (hereinafter referred to as the "New Elderly Health Act") apply to the calculation of the amount of the medical expense contribution for fiscal years from fiscal year 1986 onward, and the provisions then in force continue to govern the calculation of the amount of the medical expense contribution for fiscal years up to and including fiscal year 1985.
第一条の規定による改正後の老人保健法（以下「新老健法」という。）第五十四条第一項ただし書及び第二項の規定は、昭和六十一年度以後の年度の医療費拠出金の額の算定について適用し、昭和六十年度以前の年度の医療費拠出金の額の算定については、なお従前の例による。
With regard to the estimated medical expense contribution and the fixed medical expense contribution for fiscal years up to and including fiscal year 1985, the provisions then in force continue to govern.
昭和六十年度以前の年度の概算医療費拠出金及び確定医療費拠出金については、なお従前の例による。
Supplementary Provisions, Article 4
第四条
The amount of the estimated medical expense contribution for fiscal year 1986 is, notwithstanding Article 55, paragraph (1) of the New Elderly Health Act, to be the sum total of the amounts set forth in the following items.
昭和六十一年度の概算医療費拠出金の額は、新老健法第五十五条第一項の規定にかかわらず、次の各号に掲げる額の合計額とする。
an amount equivalent to 10/12 of the amount of the estimated medical expense contribution for fiscal year 1986 calculated based on the provisions of the Former Elderly Health Act;
旧老健法の規定に基づき算定された昭和六十一年度の概算医療費拠出金の額の十二分の十に相当する額
an amount equivalent to 7/10 of the sum total of the following amounts:
次に掲げる額の合計額の十分の七に相当する額
the amount obtained by multiplying by 20 percent the amount calculated as specified by Ministry of Health and Welfare Order as the estimated amount of expenses required for medical care and the payment of specified medical expenses (including payment of medical expenses) to be provided on or after the Effective Date to participants, etc. aged 70 or older pertaining to the Insurer concerned, which a municipality is to bear in fiscal year 1986 (referred to as "post-commencement estimated medical expenses" in (b));
the amount obtained by multiplying the amount equivalent to 80 percent of the post-commencement estimated medical expenses (excluding, for an Insurer for which the rate obtained by dividing the amount calculated as specified by Ministry of Health and Welfare Order as the post-commencement estimated medical expenses per participant, etc. aged 70 or older pertaining to the Insurer by the amount calculated as specified by Ministry of Health and Welfare Order as the average of the post-commencement estimated medical expenses per participant, etc. aged 70 or older pertaining to all Insurers (hereinafter in this item referred to as the "average estimated elderly medical expenses per person") exceeds the rate specified by Cabinet Order in consideration of the distribution, etc. of the post-commencement estimated medical expenses per participant, etc. aged 70 or older pertaining to all Insurers, the amount calculated as specified by Ministry of Health and Welfare Order as the portion exceeding the amount obtained by multiplying the average estimated elderly medical expenses per person by that rate specified by Cabinet Order (referred to as "estimated medical expenses outside adjustment" in (c))) by the estimated participant adjustment rate under Article 55, paragraph (3) of the New Elderly Health Act for fiscal year 1986;
施行日以後医療費見込額（当該保険者に係る七十歳以上の加入者等一人当たりの施行日以後医療費見込額として厚生省令で定めるところにより算定される額をすべての保険者に係る七十歳以上の加入者等一人当たりの施行日以後医療費見込額の平均額として厚生省令で定めるところにより算定される額（以下この号において「平均一人当たり老人医療費見込額」という。）で除して得た率が、すべての保険者に係る七十歳以上の加入者等一人当たりの施行日以後医療費見込額の分布状況等を勘案して政令で定める率を超える保険者にあつては、平均一人当たり老人医療費見込額に当該政令で定める率を乗じて得た額を超える部分として厚生省令で定めるところにより算定される額（ハにおいて「調整対象外医療費見込額」という。）を除く。）の百分の八十に相当する額に昭和六十一年度に係る新老健法第五十五条第三項の概算加入者調整率を乗じて得た額
the amount obtained by multiplying the estimated medical expenses outside adjustment pertaining to the Insurer concerned by 80 percent.
当該保険者に係る調整対象外医療費見込額に百分の八十を乗じて得た額
In specifying the Cabinet Order referred to in item (ii), (b) of the preceding paragraph, the Minister of Health and Welfare must hear the opinion of the Elderly Health Council in advance.
前項第二号ロの政令を定めるに当たつては、厚生大臣は、あらかじめ老人保健審議会の意見を聴かなければならない。
Supplementary Provisions, Article 5
第五条
The amount of the fixed medical expense contribution for fiscal year 1986 is, notwithstanding Article 56, paragraph (1) of the New Elderly Health Act, to be an amount equivalent to 7/10 of the sum total of the amounts set forth in the following items.
昭和六十一年度の確定医療費拠出金の額は、新老健法第五十六条第一項の規定にかかわらず、次の各号に掲げる額の合計額の十分の七に相当する額とする。
the sum total of the amounts obtained by multiplying the amount of expenses required for medical care (including payment of medical expenses) provided before the Effective Date to participants, etc. aged 70 or older pertaining to the Insurer concerned, which a municipality bore in fiscal year 1986, by each of the following rates:
the rate obtained by deducting the participant apportionment rate prescribed in (b) from 1;
一からロに規定する加入者按分率を控除して得た率
the rate obtained by multiplying the participant apportionment rate under Article 55, paragraph (1), item (ii) of the Former Elderly Health Act for fiscal year 1986 by the fixed participant adjustment rate under Article 56, paragraph (2) of the Former Elderly Health Act for fiscal year 1986;
昭和六十一年度に係る旧老健法第五十五条第一項第二号の加入者按分率に昭和六十一年度に係る旧老健法第五十六条第二項の確定加入者調整率を乗じて得た率
the sum total of the following amounts:
次に掲げる額の合計額
the amount obtained by multiplying by 20 percent the amount of expenses required for medical care and the payment of specified medical expenses (including payment of medical expenses) provided on or after the Effective Date to participants, etc. aged 70 or older pertaining to the Insurer concerned, which a municipality bore in fiscal year 1986 (hereinafter in this item referred to as "post-commencement medical expenses");
the amount obtained by multiplying the amount equivalent to 80 percent of the post-commencement medical expenses (excluding, for an Insurer for which the rate obtained by dividing the amount calculated as specified by Ministry of Health and Welfare Order as the post-commencement medical expenses per participant, etc. aged 70 or older pertaining to the Insurer by the amount calculated as specified by Ministry of Health and Welfare Order as the average of the post-commencement medical expenses per participant, etc. aged 70 or older pertaining to all Insurers (hereinafter in this item referred to as the "average elderly medical expenses per person") exceeds the rate specified by the Cabinet Order referred to in paragraph (1), item (ii), (b) of the preceding Article, the amount calculated as specified by Ministry of Health and Welfare Order as the portion exceeding the amount obtained by multiplying the average elderly medical expenses per person by that rate specified by Cabinet Order (referred to as "medical expenses outside adjustment" in (c))) by the fixed participant adjustment rate under Article 56, paragraph (2) of the New Elderly Health Act for fiscal year 1986;
施行日以後医療費額（当該保険者に係る七十歳以上の加入者等一人当たりの施行日以後医療費額として厚生省令で定めるところにより算定される額をすべての保険者に係る七十歳以上の加入者等一人当たりの施行日以後医療費額の平均額として厚生省令で定めるところにより算定される額（以下この号において「平均一人当たり老人医療費額」という。）で除して得た率が、前条第一項第二号ロの政令で定める率を超える保険者にあつては、平均一人当たり老人医療費額に当該政令で定める率を乗じて得た額を超える部分として厚生省令で定めるところにより算定される額（ハにおいて「調整対象外医療費額」という。）を除く。）の百分の八十に相当する額に昭和六十一年度に係る新老健法第五十六条第二項の確定加入者調整率を乗じて得た額

Supplementary Provisions, Article 6
第六条
The amount of the estimated medical expense contribution for each fiscal year from fiscal year 1987 through fiscal year 1989 is, notwithstanding Article 55, paragraph (1) of the New Elderly Health Act, to be an amount equivalent to 7/10 of the sum total of the amounts set forth in the following items.
昭和六十二年度から昭和六十四年度までの各年度の概算医療費拠出金の額は、新老健法第五十五条第一項の規定にかかわらず、次の各号に掲げる額の合計額の十分の七に相当する額とする。
the amount obtained by multiplying by 10 percent the amount calculated as specified by Ministry of Health and Welfare Order as the estimated amount of expenses required for medical care (including payment of medical expenses), the payment of specified medical expenses (including payment of medical expenses) and the payment of medical expenses for health care facilities for the elderly to participants, etc. aged 70 or older pertaining to the Insurer concerned, which a municipality is to bear in the relevant fiscal year (referred to as "estimated elderly medical expenses" in the following item);
the amount obtained by multiplying the amount equivalent to 90 percent of the estimated elderly medical expenses (excluding, for an Insurer for which the rate obtained by dividing the amount calculated as specified by Ministry of Health and Welfare Order as the estimated elderly medical expenses per participant, etc. aged 70 or older pertaining to the Insurer in the relevant fiscal year by the amount calculated as specified by Ministry of Health and Welfare Order as the average of the estimated elderly medical expenses per participant, etc. aged 70 or older pertaining to all Insurers in the relevant fiscal year (hereinafter in this item referred to as the "average estimated elderly medical expenses per person") exceeds the rate specified by Cabinet Order in consideration of the distribution, etc. of the estimated elderly medical expenses per participant, etc. aged 70 or older pertaining to all Insurers in the relevant fiscal year, the amount calculated as specified by Ministry of Health and Welfare Order as the portion exceeding the amount obtained by multiplying the average estimated elderly medical expenses per person by that rate specified by Cabinet Order (referred to as "estimated medical expenses outside adjustment" in the following item)) by the estimated participant adjustment rate under Article 55, paragraph (3) of the New Elderly Health Act for the relevant fiscal year;
老人医療費見込額（当該各年度における当該保険者に係る七十歳以上の加入者等一人当たりの老人医療費見込額として厚生省令で定めるところにより算定される額を当該各年度におけるすべての保険者に係る七十歳以上の加入者等一人当たりの老人医療費見込額の平均額として厚生省令で定めるところにより算定される額（以下この号において「平均一人当たり老人医療費見込額」という。）で除して得た率が、当該各年度におけるすべての保険者に係る七十歳以上の加入者等一人当たりの老人医療費見込額の分布状況等を勘案して政令で定める率を超える保険者にあつては、平均一人当たり老人医療費見込額に当該政令で定める率を乗じて得た額を超える部分として厚生省令で定めるところにより算定される額（次号において「調整対象外医療費見込額」という。）を除く。）の百分の九十に相当する額に当該各年度に係る新老健法第五十五条第三項の概算加入者調整率を乗じて得た額
the amount obtained by multiplying the estimated medical expenses outside adjustment pertaining to the Insurer concerned by 90 percent.
当該保険者に係る調整対象外医療費見込額に百分の九十を乗じて得た額
In specifying the Cabinet Order referred to in item (ii) of the preceding paragraph, the Minister of Health and Welfare must hear the opinion of the Elderly Health Council in advance.
前項第二号の政令を定めるに当たつては、厚生大臣は、あらかじめ老人保健審議会の意見を聴かなければならない。
