Article 3-13-8Special Provisions on the Calculation of the Amount of Survivors' Employees' Pension for a Beneficiary of an Employees' Old-Age Pension Based on Two or More Times in One Category Among the Categories of EPI Insured Period

In applying Article 60, paragraph (1), item (ii) of the Act where a beneficiary of a survivors' employees' pension is a beneficiary of employees' old-age pensions based on two or more times in one category among the categories of EPI insured period, the phrase "(or, for an employees' old-age pension" in (b) of that item is deemed to be replaced with "(the amount obtained by adding together the amounts of the employees' old-age pensions based on each category of EPI insured period prescribed in Article 78-22 (or, for an employees' old-age pension based on the time in one category prescribed in Article 78-22", the phrase "pursuant to the provisions of Article 44, paragraph (1)" in (b) of that item is deemed to be replaced with "pursuant to the provisions of Article 44, paragraph (1) as replaced pursuant to Article 3-13, paragraph (1) of the Order for Enforcement of the Employees' Pension Insurance Act (Cabinet Order No. 110 of 1954)", and the phrase "the amount to which those provisions do not apply;" in (b) of that item is deemed to be replaced with "the amount to which those provisions do not apply);".
