Where, within one month counting from the day on which a specific insured person died, a request for a class III split of standardized remuneration has been made by a dependent spouse (limited to a dependent spouse who, before that death, divorced the specific insured person, had the marriage annulled, or did something equivalent to these specified by Order of the Ministry of Health, Labour and Welfare as prescribed in Article 3-12-10, which is the ground for a request for a class III split of standardized remuneration), the request for a class III split of standardized remuneration is deemed to have been made on the day before the day on which that specific insured person died.
特定被保険者が死亡した日から起算して一月以内に被扶養配偶者（当該死亡前に当該特定被保険者と三号分割標準報酬改定請求の事由である離婚又は婚姻の取消しその他第三条の十二の十に規定する厚生労働省令で定めるこれらに準ずるものをした被扶養配偶者に限る。）から三号分割標準報酬改定請求があつたときは、当該特定被保険者が死亡した日の前日に三号分割標準報酬改定請求があつたものとみなす。
The provisions of the preceding paragraph apply mutatis mutandis to a request for a class III split of standardized remuneration that is deemed to have been made, pursuant to the main clause of Article 78-20, paragraph (1) of the Act, when a request for standardized remuneration to be revised or decided has been made by a specific insured person within one month counting from the day on which the dependent spouse died.
前項の規定は、法第七十八条の二十第一項本文の規定により被扶養配偶者が死亡した日から起算して一月以内に特定被保険者から標準報酬改定請求があつたときにあつたものとみなされる三号分割標準報酬改定請求について準用する。
