Supplementary Provisions

This Act comes into effect on the date of promulgation.

①The provisions of the Act on Prohibition of Private Monopolization and Maintenance of Fair Trade as amended pursuant to the provisions of Article 3 (referred to as the "New Act" in the following paragraph) apply, except for what is provided for in that paragraph, to acts that commenced on or after the date on which the provisions of that Article come into effect (hereinafter in this Article referred to as the "Effective Date"), and with regard to acts that had already ceased to exist before the Effective Date, the provisions then in force continue to govern.

②The provisions of the New Act apply to the portion on or after the Effective Date of acts that commenced before the Effective Date and ended on or after the Effective Date, and with regard to the portion of those acts before the Effective Date, the provisions then in force continue to govern.

With regard to the application of penal provisions to acts committed before this Act (or, for the provisions prescribed in the proviso to Article 1 of the Supplementary Provisions, those provisions; the same applies hereinafter in this Article) comes into effect and to acts committed after this Act comes into effect in the cases where the provisions then in force are to continue to govern pursuant to the provisions of these Supplementary Provisions, the provisions then in force continue to govern.

In addition to what is provided for in Article 2 through the preceding Article of the Supplementary Provisions, transitional measures necessary for the enforcement of this Act are specified by Cabinet Order.
