Article 471Defense by Additional Obligor in Cumulative Assumption of an Obligation
第四百七十一条（併存的債務引受における引受人の抗弁等）
An additional obligor may duly assert against the obligee any defense that could have been asserted by the initial obligor at the time when the cumulative assumption of an obligation became effective, with regard to the obligation that the additional obligor has assumed through the cumulative assumption of an obligation.
引受人は、併存的債務引受により負担した自己の債務について、その効力が生じた時に債務者が主張することができた抗弁をもって債権者に対抗することができる。
If the initial obligor has a right to revoke or right to cancel against the obligee, the additional obligor may refuse to perform the obligation to the obligee to the extent that the initial obligor should have been released from the obligation by exercising either of these rights.
債務者が債権者に対して取消権又は解除権を有するときは、引受人は、これらの権利の行使によって債務者がその債務を免れるべき限度において、債権者に対して債務の履行を拒むことができる。
