Holders of general statutory liens may not be paid out of immovables unless they are first paid out of property other than immovables and a claim that is not satisfied remains.
一般の先取特権者は、まず不動産以外の財産から弁済を受け、なお不足があるのでなければ、不動産から弁済を受けることができない。
With respect to immovables, holders of general statutory liens must first be paid out of those that are not the subject of special security.
一般の先取特権者は、不動産については、まず特別担保の目的とされていないものから弁済を受けなければならない。
If holders of general statutory liens fail to participate in distributions in accordance with the provisions of the preceding two paragraphs, they may not exercise their statutory liens against registered third parties with respect to amounts that would have been paid to them if they had participated in the distribution.
一般の先取特権者は、前二項の規定に従って配当に加入することを怠ったときは、その配当加入をしたならば弁済を受けることができた額については、登記をした第三者に対してその先取特権を行使することができない。
The provisions of the preceding three paragraphs do not apply if the proceeds of immovables are distributed before the proceeds of assets other than immovables, or if the proceeds of immovables that are the subject of a special security are distributed before the proceeds of other immovables.
前三項の規定は、不動産以外の財産の代価に先立って不動産の代価を配当し、又は他の不動産の代価に先立って特別担保の目的である不動産の代価を配当する場合には、適用しない。
