A statutory lien for expenses for the custody of a child exists with respect to the amount appropriate as expenses required for the custody of a child (meaning the amount calculated, as provided by Ministry of Justice Order in accordance with the number of children who are to be supported by the periodic payments, taking into account the standard expenses required for the custody of a child and other circumstances), out of the periodic payments for each period under a claim for periodic payments with a fixed due date that arises from any of the following obligations:
子の監護の費用の先取特権は、次に掲げる義務に係る確定期限の定めのある定期金債権の各期における定期金のうち子の監護に要する費用として相当な額（子の監護に要する標準的な費用その他の事情を勘案して当該定期金により扶養を受けるべき子の数に応じて法務省令で定めるところにより算定した額）について存在する。
the duty between the husband and wife to cooperate and be of assistance to each other under the provisions of Article 752;
第七百五十二条の規定による夫婦間の協力及び扶助の義務
the duty regarding the sharing of expenses that arise from marriage under the provisions of Article 760;
第七百六十条の規定による婚姻から生ずる費用の分担の義務
the duty relating to the custody of a child under the provisions of Article 766 and Article 766-3 (including where these provisions are applied mutatis mutandis under Article 749, Article 771, and Article 788);
the duty of support under the provisions of Article 877 through Article 880.
