旧古物営業法第十条第一項の規定により交付された行商又は露店の許可に係る許可証は、当該許可証の有効期間の満了する日までの間は、新古物営業法第十条第一項の規定により交付された行商の許可に係る許可証とみなす。

第一条の規定の施行の際現に旧古物営業法第八条第一項の規定による行商及び露店の許可又は同条第二項の規定による行商及び露店の許可を受けている者に係る当該行商又は露店の許可のうち有効期間の残存期間の短い許可証に係る許可については、前二項の規定にかかわらず、第一条の規定の施行の日にその効力を失うものとし、当該許可に係る許可証は、第一条の規定の施行後速やかに当該都道府県公安委員会に返納しなければならない。

第一条の規定の施行の際現に都道府県公安委員会に対しされている旧古物営業法第八条第一項又は第二項の規定による行商又は露店の許可に係る申請は、それぞれ新古物営業法第八条第一項又は第二項の規定による行商の許可に係る申請とみなす。

この法律（第一条については、同条の規定）の施行前にした行為及び附則第五項の規定により従前の例によることとされる場合における第一条の規定の施行後にした行為に対する罰則の適用については、なお従前の例による。
