Supplementary Provisions, Article 6Transitional Measures Accompanying the Partial Amendment of the Act against Unjustifiable Premiums and Misleading Representations
第六条（不当景品類及び不当表示防止法の一部改正に伴う経過措置）
Fair Trade Commission Rules issued pursuant to the provisions of Article 5, paragraph (1) or Article 12, paragraph (1) or (4) of the Act against Unjustifiable Premiums and Misleading Representations prior to the amendment by the provisions of Article 12 (referred to below in this Article as the "former Premiums and Representations Act") are to have effect as a Cabinet Office Order under Article 7, paragraph (3) of the Act for Establishment of the Cabinet Office issued pursuant to the provisions of Article 5, paragraph (1) or Article 11, paragraph (1) or (4) of the Act against Unjustifiable Premiums and Misleading Representations as amended by the provisions of Article 12 (referred to below in this Article as the "new Premiums and Representations Act").
第十二条の規定による改正前の不当景品類及び不当表示防止法（以下この条において「旧景品表示法」という。）第五条第一項又は第十二条第一項若しくは第四項の規定により発せられた公正取引委員会規則は、第十二条の規定による改正後の不当景品類及び不当表示防止法（以下この条において「新景品表示法」という。）第五条第一項又は第十一条第一項若しくは第四項の規定により発せられた内閣府設置法第七条第三項の内閣府令としての効力を有するものとする。
A restriction or prohibition under the provisions of Article 3 of the former Premiums and Representations Act made by the Fair Trade Commission before the Effective Date is deemed to be a restriction or prohibition under the provisions of Article 3 of the new Premiums and Representations Act made by the Prime Minister on the Effective Date.
施行日前に公正取引委員会がした旧景品表示法第三条の規定による制限又は禁止は、施行日に内閣総理大臣がした新景品表示法第三条の規定による制限又は禁止とみなす。
The provisions of Article 6 of the new Premiums and Representations Act also apply to an act in violation of a restriction or prohibition under the provisions of Article 3 of the former Premiums and Representations Act or of the provisions of Article 4, paragraph (1) of the former Premiums and Representations Act that was committed before the Effective Date; provided, however, that in the case where an order under the provisions of Article 6, paragraph (1) of the former Premiums and Representations Act was issued before the Effective Date, the provisions then in force continue to govern the application of the provisions of the Act on Prohibition of Private Monopolization and Maintenance of Fair Trade (Act No. 54 of 1947) with regard to that order and the act of violation relating to that order, and an appeal against that order.
新景品表示法第六条の規定は、施行日前にされた旧景品表示法第三条の規定による制限若しくは禁止又は旧景品表示法第四条第一項の規定に違反する行為についても適用があるものとする。ただし、施行日前に旧景品表示法第六条第一項の規定による命令がされた場合における当該命令及び当該命令に係る違反行為に関する私的独占の禁止及び公正取引の確保に関する法律（昭和二十二年法律第五十四号）の規定の適用並びに当該命令についての不服の申立てについては、なお従前の例による。
An agreement or rules that have obtained approval pursuant to the provisions of Article 12, paragraph (1) of the former Premiums and Representations Act at the time this Act comes into effect are deemed to be an agreement or rules that obtained the approval by the Prime Minister and the Fair Trade Commission pursuant to the provisions of Article 11, paragraph (1) of the new Premiums and Representations Act on the Effective Date.
この法律の施行の際現に旧景品表示法第十二条第一項の規定により認定を受けている協定又は規約は、施行日に新景品表示法第十一条第一項の規定により内閣総理大臣及び公正取引委員会の認定を受けた協定又は規約とみなす。
The provisions then in force continue to govern an appeal against a disposition made by the Fair Trade Commission pursuant to the provisions of Article 12, paragraph (1) or (3) of the former Premiums and Representations Act before the Effective Date.
施行日前に旧景品表示法第十二条第一項又は第三項の規定により公正取引委員会がした処分についての不服の申立てについては、なお従前の例による。
