If a prefectural governor, a mayor of a city with a public health center, or a mayor of a special ward of Tokyo finds that there is a risk that an advertisement related to a medical practice, a dental practice, or midwifery services, or to a hospital, clinic, birthing center or facility for receiving online medical care violates the provisions of Article 6-5, paragraphs (1) through (3) or the preceding two Articles, the governor or mayor may order the party that placed the relevant advertisement to report as required, or may have the relevant official enter the offices of the party that placed the relevant advertisement, and inspect documents or other articles related to the relevant advertisement.
都道府県知事、保健所を設置する市の市長又は特別区の区長は、医業、歯科医業若しくは助産師の業務又は病院、診療所、助産所若しくはオンライン診療受診施設に関する広告が第六条の五第一項から第三項まで又は前二条の規定に違反しているおそれがあると認めるときは、当該広告をした者に対し、必要な報告を命じ、又は当該職員に、当該広告をした者の事務所に立ち入り、当該広告に関する文書その他の物件を検査させることができる。
If a prefectural governor, a mayor of a city with a public health center, or a mayor of a special ward of Tokyo finds that an advertisement related to a medical practice, a dental practice, or midwifery services, or to a hospital, clinic, birthing center or facility for receiving online medical care violates the provisions of Article 6-5, paragraph (2) or (3), Article 6-7, paragraph (2) or (3), or the preceding Article, the governor or mayor may order the party that placed the relevant advertisement to discontinue the relevant advertisement or correct its contents by a set deadline.
An official who enters and inspects pursuant to the provisions of paragraph (1) must carry a certificate for identification and present it when requested by the concerned parties.
第一項の規定によつて立入検査をする当該職員は、その身分を示す証明書を携帯し、かつ、関係人の請求があるときは、これを提示しなければならない。
The authority granted pursuant to the provisions of paragraph (1) must not be construed as being approved for a criminal investigation.
第一項の規定による権限は、犯罪捜査のために認められたものと解釈してはならない。
