What this law does

  • Many of its provisions fill in a matter that the Income Tax Act or its Cabinet Order (政令) leaves "to be prescribed by Order of the Ministry of Finance" (財務省令で定める), naming 法 (the Act) for the Income Tax Act and 令 (the Order) for the Order for Enforcement of the Income Tax Act (所得税法施行令), a Cabinet Order this site does not hold. Its words such as resident (居住者), non-resident (非居住者) and withholding (源泉徴収) mean what the Act's Article 2(1) defines them to mean.(Art. 1(1), Art. 1(2), Art. 47(1)) (the provisions it rests on)

  • It lists what a final tax return (確定申告書) must state beyond the Act's figures, starting with the filer's name, address and Individual Number (個人番号). Where the Act requires a breakdown of gross revenue and necessary expenses — for a filer with real property, business or timber income who does not file a blue return (青色申告書), and for one whose revenue from a business giving rise to miscellaneous income was over 10 million yen two years before — the breakdown is made for each kind of income, item by item (sales, rent, wages paid, depreciation, rent paid, interest and so on), with a comparable item used where a listed one does not fit the business.(Art. 47(3), Art. 47(3)(i), Art. 47-3(1), Art. 47-3(1)(i), Art. 47-3(1)(ii), Income Tax Act Art. 120(6)) (the provisions it rests on)
  • A resident who was at any time in the year a non-permanent resident (非永住者) — someone without Japanese nationality who has lived in Japan for no more than five of the past ten years — attaches to the return a document stating their nationality; the days they came to live in Japan and stopped living there in each of the ten years before; how long in the year they were a non-permanent resident, another resident and a non-resident; and, for the non-permanent period, their income other than foreign-source income (国外源泉所得), and their foreign-source income with how much of it was paid in Japan or remitted from abroad.(Art. 47-4(1), Art. 47-4(1)(i), Art. 47-4(1)(ii), Art. 47-4(1)(iii), Art. 47-4(1)(iv), Income Tax Act Art. 120(7), Income Tax Act Art. 2(1)(iv)) (the provisions it rests on)
  • To have a relative who lives outside Japan (国外居住親族) counted as a spouse or dependant — on the return for deduction for dependents (扶養控除等申告書) given to an employer, or on a final tax return — a resident provides a document showing they are the spouse or relative claimed (a copy of the family register's annex (戸籍の附票) or another document a Japanese national or local government issued, with a copy of the passport; or a document a foreign government issued with the relative's name, date of birth and address) and records from a bank, a credit-card company or an electronic payment service showing that the resident paid that relative's living or education costs each time they were needed, with a translation of anything in a foreign language. A dependant abroad aged 30 or over and under 70 counts only as a student abroad, as a person with a disability, or on support: for support, the records must show 380,000 yen or more paid to that person in the year; for a student, a copy of a foreign visa or of a foreign residence card that a foreign government issued must show they live abroad on a status like Japan's Student status (留学).(Art. 73-2(2), Art. 73-2(2)(i), Art. 73-2(2)(ii), Art. 73-2(3), Art. 73-2(4), Art. 47-2(5), Art. 47-2(6), Art. 47-2(7), Art. 47-2(8), Art. 47-2(9), Art. 47-2(10), Income Tax Act Art. 2(1)(xxxiv-2)) (the provisions it rests on)
  • An employer paying salary in Japan to a resident makes two copies of a withholding receipt (源泉徴収票) for each person, on the form in Appended Table VI (1), files one with the district tax office director and gives the other to the person, by 31 January of the next year or within a month of the person leaving, as Article 226(1) of the Act sets. It shows the year's pay, the income tax withheld, the social insurance premiums deducted and the spouse and dependants counted, and, for pay settled by year-end adjustment (年末調整), the income after the employment income deduction. At each payment of salary, retirement allowance or public pension, the payer also gives a pay slip (支払明細書) showing the amount, the income tax withheld and any over-withheld tax refunded; a public-pension payer may instead show the year's later payments on one slip.(Art. 93(1), Art. 93(1)(ii), Art. 93(1)(iii), Art. 93(1)(iv), Art. 93(1)(v), Art. 93(1)(vi), Art. 95(1), Form No. 6-1, Art. 100(1), Art. 100(2), Income Tax Act Art. 226(1)) (the provisions it rests on)
  • A blue-return filer (青色申告者) records every transaction affecting the assets, liabilities and capital of the business by the principles of double-entry bookkeeping (正規の簿記), keeps a journal and a general ledger, takes stock and draws up a balance sheet and a profit and loss statement as of 31 December (or the day of death or of leaving Japan), and keeps the books and documents at home or at the business for seven years from the day after 15 March of the year after the one they were closed, made or received — five years only for orders, contracts, invoices, receipts and similar transaction documents not made on receiving or paying out cash or deposits. Others with real property, business or timber income record their revenue and expenses by a simple method the Minister of Finance sets, and keep that book for seven years and other books and documents for five. Someone whose revenue from a business giving rise to miscellaneous income was over 3 million yen two years before keeps the invoices, receipts and similar documents made on receiving or paying out cash or deposits for five years from the day after 15 March of the next year.(Art. 56(1), Art. 57(1), Art. 58(1), Art. 60(1), Art. 61(1), Art. 63(1), Art. 63(1)(iii), Art. 63(3), Art. 63(4), Art. 102(1), Art. 102(2), Art. 102(4), Art. 102(7), Art. 102(8), Income Tax Act Art. 232(1), Income Tax Act Art. 232(2)) (the provisions it rests on)

Who it applies to

It applies to

  • Individuals who file a final tax return or another return, application or notice under the Income Tax Act — non-residents too, for their own returns and for notices of starting a business — as to what it must state and what must be attached to it.(Art. 47(3)(i), Art. 47-2(13), Art. 55(1), Art. 69(1), Art. 98(1)) (the provisions it rests on)
  • Employers and others who pay salary, retirement allowances or public pensions in Japan to residents: they issue withholding receipts for each and pay slips; they keep the returns for deduction for dependents and other withholding returns their employees hand in until the tax office asks for them, for up to seven years from the day after 10 January of the year after the year of the filing deadline; and they notify the tax office when they open, move or close an office that handles payroll.(Art. 93(1), Art. 94(1), Art. 94-2(1), Art. 100(1), Art. 76-3(1), Art. 99(1)) (the provisions it rests on)
2 more
  • Those who pay interest, dividends, professional fees, insurance benefits and other payments the Act lists, and corporations and certain real-estate dealers that pay rent, a price for real property or a brokerage fee: they file a payment report (支払調書) on each recipient with the district tax office director, on the forms in Appended Tables V (1) to V (32).(Art. 82(1), Art. 83(1), Art. 84(1), Art. 86(1), Art. 90(1), Art. 91(1), Income Tax Act Art. 225(1), Income Tax Act Art. 225(1)(ix)) (the provisions it rests on)
  • Residents with real property, business or timber income, and non-residents with such income from sources in Japan: they keep books and records, and file a notice with the district tax office director when they start such a business in Japan or open, move or close its office there, stating among other things when and what the business is.(Art. 56(1), Art. 102(1), Art. 102(9), Art. 98(1), Art. 98(1)(ii), Art. 98(1)(iii)) (the provisions it rests on)
Special rules and exceptions (9)
  • A withholding receipt is still given to the person paid but need not be filed with the tax office where, in the year, salary settled by year-end adjustment (年末調整) came to 5,000,000 yen or less (other than pay to company officers and to some professionals the Act names); a company's officers (役員, advisers included) were paid 1,500,000 yen or less so settled; other salary, not to an officer, paid by the employer that received the person's return for deduction for dependents came to 2,500,000 yen or less; or any other salary came to 500,000 yen or less. This is the rule until 31 December 2026.(Art. 93(2), Art. 93(2)(i), Art. 93(2)(ii), Art. 93(2)(iii), Art. 93(2)(iv), Income Tax Act Art. 204(1)(ii)) (the provisions it rests on)
  • A withholding receipt is still given to the person paid, but the rule that lets it go unfiled with the tax office now covers only a person who left the job during the year and was paid 300,000 yen or less in salary by the employer that year. Under Article 10(1) of the supplementary provisions of Ministry of Finance Order No. 12 of 2023, it governs every withholding receipt due to be filed from the day it takes effect — the receipts for the previous year's pay, due by 31 January, included — while receipts that were due before keep the earlier thresholds. This is the rule from 1 January 2027.(Art. 93(2), Suppl. Prov. Art. 10(1), Income Tax Act Art. 226(1)) (the provisions it rests on)
  • No payment report need be filed for small amounts paid to one person in the year: fees for medical treatment, for salespeople, bill collectors, meter readers and professional boxers, and some others, of 500,000 yen or less; most other fees of 50,000 yen or less; interest of 30,000 yen or less (and none for ordinary deposits); insurance agents' commissions of 200,000 yen or less; real-property sale prices of 1,000,000 yen or less; and rent or brokerage fees of 150,000 yen or less.(Art. 84(2), Art. 84(2)(i), Art. 84(2)(iv), Art. 82(2), Art. 82(2)(ii), Art. 82(2)(iii), Art. 88(2), Art. 90(3)) (the provisions it rests on)
  • An employer or public-pension payer that files the salary payment report (給与支払報告書) or public pension payment report (公的年金等支払報告書) with the head of the municipality, carrying the particulars this Order lists for the withholding receipt, is treated as having filed the withholding receipt with the tax office for the pay that report covers. This applies to withholding receipts due to be filed from the day this rule takes effect, under Article 8 of the supplementary provisions of Act No. 3 of 2023.This is the rule from 1 January 2027.(Art. 95-3(1), Art. 95-3(1)(i), Art. 95-3(1)(ii), Income Tax Act Art. 226(6) from 1 January 2027, Income Tax Act Suppl. Prov. Art. 8(1) from 1 January 2027) (the provisions it rests on)
  • A blue-return filer may keep books by a simpler method of recording and simpler entries that the Minister of Finance sets and publishes in a public notice (告示), instead of the full double-entry rules; one who uses the cash-basis rule for small businesses in Article 67(1) of the Act need not take stock at the year end.(Art. 56(1), Art. 56(2), Art. 56(3), Income Tax Act Art. 67(1)) (the provisions it rests on)
  • A blue-return filer whose real property and business income two years before was at or below an amount the Order for Enforcement of the Income Tax Act (a Cabinet Order (政令) this site does not hold) sets need keep that year's invoices, receipts and similar documents for five years only.(Art. 63(2), Art. 63(1)(iii)) (the provisions it rests on)
  • An employer may send the withholding receipt electronically instead of on paper only with the person's consent, given in writing or electronically after being told the method and the file format; where the employer has said that no answer by a set date counts as consent, and none comes, consent is deemed given. The person can still ask for it on paper.(Art. 95-2(1), Art. 95-2(2), Income Tax Act Art. 226(4)) (the provisions it rests on)
  • A blue-return filer for whom the bookkeeping rules are hard to follow given the business's type, form or size may, with the district tax office director's approval, leave out or change some of the required entries.(Art. 64(1)) (the provisions it rests on)
  • A payer who pays salary only to domestic workers (家事使用人), regularly no more than two, need not withhold income tax from that salary and pay it to the State, and need not make a withholding receipt (源泉徴収票) for it (Articles 184(1) and 226(1) of the Act).(Income Tax Act Art. 184(1), Income Tax Act Art. 226(1), Art. 93(1)) (the provisions it rests on)
How it is enforced (3)
  • This Ministerial Order (省令) sets no penalties of its own; they are in the Income Tax Act. Under Article 242 of the Act, not giving a withholding receipt or pay slip to the person paid, or giving one with false entries, and not filing withholding receipts or payment reports (支払調書) with the tax office by the deadline, or filing them with false entries, is punishable by imprisonment (拘禁刑) of up to one year or a fine of up to 500,000 yen. Where an employee, agent or representative commits such an offence in the course of a company's or a person's business, the company or person is fined as well (Article 243 of the Act).(Art. 93(1), Art. 100(1), Art. 91(1), Income Tax Act Art. 242(1), Income Tax Act Art. 242(1)(v), Income Tax Act Art. 242(1)(vi), Income Tax Act Art. 242(1)(vii), Income Tax Act Art. 243(1)) (the provisions it rests on)
  • If a blue-return filer's books are not kept, written up and kept on file as this Order requires, the filer does not follow the district tax office director's instructions on them, or the books conceal or disguise transactions or give good reason to doubt the truth of what they record, the director may rescind the approval to file blue returns back to that year, by written notice stating the ground. The returns filed from then on are treated as ordinary returns.(Art. 56(1), Income Tax Act Art. 148(1), Income Tax Act Art. 150(1), Income Tax Act Art. 150(1)(i), Income Tax Act Art. 150(2), Income Tax Act Art. 150(1)(ii), Income Tax Act Art. 150(1)(iii)) (the provisions it rests on)
  • Where the Act or its Cabinet Order (政令) makes something depend on the district tax office director's approval — filing blue returns, valuing inventory by a special method, being excused from the withholding-receipt rules of Article 226(1) of the Act — this Order sets what the application must state. An application to file blue returns that the director has not approved or rejected by 31 December of the year it is for (15 February of the next year for a business started on or after 1 November) is treated as approved.(Art. 55(1), Art. 22(1), Art. 93(3), Income Tax Act Art. 226(1), Income Tax Act Art. 147(1)) (the provisions it rests on)

The Ministry of Justice translated only part of this law: the limited to the provisions related to nonresidents and foreign corporations, as the law stood after Ministry of Finance Order No. 17 of 2009 amended it. The rest of the law has no Ministry translation.

The Ministry of Justice's translation is shown only where the Japanese it translates matches the law in force today. Everywhere else the English is a machine translation, marked on the paragraph itself.

Only the Japanese is the law, and no lawyer has reviewed the machine translation.
