通信販売
A sale of goods (商品) or specified rights (特定権利), or provision of services, by a seller or service provider on receiving the offer by post or another method an order of the competent ministry (主務省令) specifies (郵便等), other than a telemarketing sale (電話勧誘販売).

The transactions this Act regulates: those connected with door-to-door sales (訪問販売), mail order sales (通信販売) and telemarketing sales (電話勧誘販売), multilevel marketing transactions (連鎖販売取引), transactions connected with the provision of specified continuous services (特定継続的役務提供), business opportunity sales transactions (業務提供誘引販売取引), and transactions connected with door-to-door purchases (訪問購入).

Services a Cabinet Order (政令) specifies that are provided continuously for payment in everyday transactions, where customers are drawn in with the promise of a personal goal — improving their appearance, knowledge or skills, or another goal concerning their body, mind or circumstances — and whether that goal will be achieved is by nature uncertain.
国民の日常生活に係る取引において有償で継続的に提供される役務であつて、次の各号のいずれにも該当するものとして、政令で定めるもの
A transaction (including a change in its terms) in which a person carrying on a multilevel marketing undertaking (連鎖販売業) sells goods or provides services, or arranges either, to someone drawn in to resell or sell the goods or to provide the same kind of services by the prospect of a specified profit (特定利益), and which involves a specified burden (特定負担) for that person.

特定権利
In Chapter 2 (door-to-door, mail order and telemarketing sales) and a few later provisions, any of these rights: a right to use facilities or receive services that is sold in everyday transactions and specified by Cabinet Order (政令); a corporate bond or other monetary claim; or a share in a stock company, an equity interest in a limited liability, general partnership or limited partnership company, another membership right in an incorporated association, or a similar right in a foreign corporation.

Either providing specified continuous services (特定継続的役務) under a contract to provide them for longer than a period, and for more than an amount, that a Cabinet Order (政令) sets for each service (a specified continuous service contract, 特定継続的役務提供契約), or selling the right to receive such services for longer than that period for more than that amount (under a sales contract for specified rights, 特定権利販売契約).

In Article 15-3, the person who made an offer to buy, or who bought, goods or specified rights (特定権利) from a seller that advertised the terms of their sale by mail order (通信販売).

A business of selling articles or providing services for payment (or arranging either) that draws people in with the prospect of profit from work using those goods or services, offered or arranged by the business itself, and makes transactions with them that involve a specified burden (特定負担) — buying the goods, paying for the services or providing a transaction fee (取引料).

業務提供誘引販売業

業務提供誘引販売取引

統括者
The person who in substance runs a set of related multilevel marketing undertakings (連鎖販売業) — for example by putting its own trademark on the goods, having its trade name or another mark used for the services, setting the terms and conditions of the transactions, or continuously guiding the operations of those who carry on the undertakings.
連鎖販売業に係る商品に自己の商標を付し、若しくは連鎖販売業に係る役務の提供について自己の商号その他特定の表示を使用させ、連鎖販売取引に関する約款を定め、又は連鎖販売業を行う者の経営に関し継続的に指導を行う等一連の連鎖販売業を実質的に統括する者
統括者
The person who in substance runs a set of related multilevel marketing undertakings (連鎖販売業) — for example by putting its own trademark on the goods, having its trade name or another mark used for the services, setting the terms and conditions of the transactions, or continuously guiding the operations of those who carry on the undertakings.

勧誘者

使用人
An employee in a position a Cabinet Order (政令) specifies, such as a person who runs the business of a business office (営業所).
A purchase of articles (物品) by a person who buys articles as a business (a buyer, 購入業者), under a contract offered or made away from its business office or similar place (営業所等) — except articles a Cabinet Order (政令) excludes because buying them this way is unlikely to harm the seller's interests or because applying these rules would seriously disrupt their distribution.

A way of using an electronic data processing system or other information and communications technology, of a kind an order of the competent ministry (主務省令) specifies — used, for example, when a seller or service provider, with the customer's consent, provides the contents of a document it must hand over instead of the paper itself.

A general incorporated association set up under Article 30 whose name includes the words 通信販売協会 (mail order sales association), whose purpose is to make mail order sales fair, protect purchasers and service recipients and help the business develop soundly, and whose members are businesses engaged in mail order sales.
A qualified consumer organization as defined in Article 2, paragraph (4) of the Consumer Contract Act (Act No. 61 of 2000): a consumer organization (消費者団体) that is a corporation and that the Prime Minister (内閣総理大臣) has certified under Article 13 of that Act as fit to exercise the right to demand an injunction (差止請求権) in the interest of consumers at large.

特定継続的役務提供受領者等
In the chapter on specified continuous services, a person who receives specified continuous services (特定継続的役務) under a specified continuous service contract (特定継続的役務提供契約), or who buys the right to receive them under a sales contract for specified rights (特定権利販売契約).
In the supplementary provisions (附則) of Act No. 43 of 1988, goods that were designated goods (指定商品) under Article 2, paragraph (3) of this Act both as amended by that Act and before it.
電話勧誘顧客
The person a seller or service provider solicits by telephone (電話勧誘行為) with a view to a sales contract or service contract (役務提供契約).
Post, or another means an order of the competent ministry (主務省令) specifies, used for receiving offers or making contracts in mail order sales (通信販売) and telemarketing sales (電話勧誘販売).

In Article 12-5, an advertisement sent by fax setting out the terms on which goods or specified rights (特定権利) are sold, or services provided, by mail order (通信販売).
割賦販売
An installment sale as defined in Article 2, paragraph (1) of the Installment Sales Act (Act No. 159 of 1961) — among other things, selling designated goods or rights (指定商品, 指定権利), or providing designated services (指定役務), on terms that the price is received over two months or more in three or more payments.

In the multilevel marketing chapter, the other party to a multilevel marketing contract (連鎖販売契約), limited to an individual who sells or provides the chain's goods or services, or arranges their sale or provision, without a store or similar facility (店舗等).

電話勧誘行為
Soliciting a sales contract or service contract (役務提供契約) during a telephone call that a seller or service provider makes, or has the customer make by a method a Cabinet Order (政令) specifies.

A person to whom a seller or service provider has entrusted, all together, the tasks listed in Article 12-3, paragraph (5): getting recipients' consent to, or requests for, its mail order email advertising (通信販売電子メール広告), making and keeping the records of them, and showing recipients what they need to say they want no more.

An offer to enter into a sales contract or service contract (役務提供契約) in a mail order sale (通信販売) that a customer makes on a form the seller or service provider (or someone it has entrusted) provides, or by following steps it displays on the screen of the customer's computer.
特定利益
In the multilevel marketing rules, all or part of the transaction fees (取引料) paid by other people who resell, sell on consignment or arrange sales of the goods, or who provide or arrange the same kind of services, and of other profits meeting requirements set by order of the competent ministry (主務省令) — the gain used to draw people into multilevel marketing.

A store (店舗) or similar facility; several of this Act's provisions on multilevel marketing (連鎖販売取引) protect individuals who sell or provide the chain's goods or services, or arrange their sale or provision, without one.
連鎖販売取引電子メール広告受託事業者
A person to whom an orchestrator (統括者), solicitor (勧誘者) or general multilevel marketing distributor (一般連鎖販売業者) has entrusted, all together, the tasks listed in Article 36-3, paragraph (5): getting recipients' consent to, or requests for, its multilevel marketing email advertising (連鎖販売取引電子メール広告), making and keeping the records of them, and showing recipients what they need to say they want no more.
